Buying online (eBay)

Options
when buying goods online from a business is it ok for them to state in their terms that any returns will be returned at buyers expense and be subject to a 20% admin fee?
I thought that they had to refund the total purchase price.

Just to be clear is this in the case of the product being faulty or for a change of mind?

Even for a change of mind they can't normally levy an "admin fee". What sort of products are we talking here and is this a consumer purchase?

If you're buying as a business then yes they can.

As a consumer though no they can't, but Ebay is full of international sellers and they don't know the rights of every country they sell too.

If you need to send something back then there are rights they have too however, such as handling within reasonable grounds etc.

But you can basically ignore the T&C's of these sellers as Ebay will just make them refund you within the law and above anyway.

The company are UK based, here is their returns policy.

We offer a 7 days refund policy on unwanted items you have purchased and it hasn't been fitted or used. We can grant a refund on the item ONLY less a 20% administration fee. Refunds will only be given when the item has been returned back to us and not before.

PLEASE CONTACT US PRIOR TO RETURNING ANY GOODS TO OBTAIN A RETURNS FORM / AUTHORIZATION

    Faulty Policy:

Any faulty products will be repaired or replaced. No refunds can be given to faulty products after the 7 days from date of purchase. Any items found NOT to be faulty on testing the customer will have to pay an £8 re-delivery charge.

You still haven't told what type of product this is or whether this is a consumer or business purchase?

No they can't but they can charge a fee for any lost value in the product if it's used. Of course if it's returned in the original packaging as it arrived then no charges will apply.

So to the OP, for change of mind they can't charge an admin fee although they can charge you for the return postage. Any extra costs depends on what you've done with the product.

    I'll assume it's these guys - http://stores.ebay.co.uk/caraudiowarehouse2012?_trksid=p2047675.l2563

Agreed, those particular terms you posted are not correct with reference to consumer sales but they do have adverts where their T&Cs are more in line with UK consumer law, see the refund policy on this one for example - http://www.ebay.co.uk/itm/MTX-BMW-E-F-SERIES-MINI-X3-X5-Underseat-Subwoofer-Front-Door-Car-Speakers-/172886159036?hash=item2840d16ebc

I'd hazard a guess with the amount of items they have that they simply relist things without updating their adverts. In any case, have you raised this issue with them.
