    Rather than abuse those who try to help you why not either repay what you owe or just come back when you have a ccj. At least with a ccj the default date is irrelevant as the 6 years restarts so there is no more arguing.

    I beg to differ.

    Under a CPR 31 request under a blue county court claim form, this is one of the documents you can request.

    My concern is this, the debt purchaser is claiming the default is 3rd August 2012, the original creditor mbna tell me its 25th September.

    Surely there is a requirement under ICO guidelines to make sure the date of default is correct on your credit file!?

    If max recovery are refusing to suppply me with proof of default date then what?

    If a claims form has been then of course they will refuse it, it may be something you can request but they will deem they don't need to provide it - why would they give you anything that could be used against them. You could put it on your defence section of the form and max recovery could provide to the court at that stage. You would then have 1 month to pay in full to avoid the CCJ staying on your file, because it really isn't a defence, and they will provide it to the court not to you.
