Lowell Default.

Hi all, looking for a bit of advice.
I had a Tesco Mobile contract which I went into the store and, certainly said I wanted to cancel but never actually got cancelled - I'd moved my partners contract over to 3 so the Tesco SIM card was destroyed.
I'd kept making DD payments for a few months until I realised and cancelled the DD, I should've kicked off at Tesco but didn't - my mistake!
A couple of months later I got a letter from Lowells, say I owe £75.

The contract was taken out in March 2012, the default on my file was registered with Lowells in May 2014.

I have finally stopped ignoring them and sent a 'prove it' letter and now received the following reply (shortened slightly):

"We note your comments but think there is sufficient evidence to confirm your liability. With a view to resolving the matter quickly we have decided to take no further action and have closed your account. We are not prepared to remove any registered default with the credit reference agencies in respect of your account as we consider the data is correct. We trust this now concludes the matter, we won't reply to any correspondence in regards to your account."

If I want to get this default removed, what's my best plan of action, if I have one at all?

  • You would need to raise a dispute with the CRAs, based on the above.

    However, it's not clear from your post whether you didn't properly cancel the contract, or Tesco failed to process it properly.

    If the former, you're unlikely to get it removed.
  • zx81 - thank you. As far as I had been concerned, I had cancelled it in store, obviously not as this has all happened. I'll raise the dispute, I've got nothing to lose.

    Even though you went into stoee you should have tried writing to them
