Problem with my car insurance pleeeeease heeeeelp!

I had an increase of £44 on my car insurance after a silly accident, and even though the other party has never made a claim against me, since they know they were wrong.

I was going to work, and my car was parked, as usual, on the street where I live. I was getting inside my car, and I saw a car coming but I thought I had plenty of time to get inside, I got inside and the door was not completely shut yet, when this car driving fast, did smash his wing mirror against my door, and they wanted £20 from me to replace the wing mirror. I called my insurance, and now I got £44 extra on my insurance just because of this phone call, even though the other party never made a claim against me.

Is this legal?

  • Not sure I understand, If it wasn't your fault why would you pay? and what do you mean your insurance wants £44? What for?

    It's normal and perfectly legal for an accident to affect your premium, whether or not you were to blame and whether or not a claim was actually made.

    However your premium would not normally change until renewal time, when you would be free to take your business elsewhere if you thought you were being overcharged. Are you saying they increased it before your renewal date?

  • Your insurer has probably logged this as a split liability claim, rather than a non-fault claim based on the circumstances.

    Yes my renewal date is in a few days and yes they increased before my renewal date

    I am sure the other party will never make a claim against me, they know they are wrong, probably those people did not even have an insurance, they gave me all their details a part from their insurance details the day of the accident. However there is a witness, someone who saw the scene, and i will ask him if he can share his statement with my insurance...
    My insurer said they considered the claim i think 50% to 50% for now until the claim will be settled, they said if from now to 6 month the other party will not make any claim against me, they will refund the money to me they have increased now, and also they will give me back my 12 years no claim bonus...

    I remember when I called my insurance, and i was telling them what happened during the accident, these people wanted to run away, but i run towards them and i did let one of the them (the driver) to talk with my insurance, and the driver was trying to blame me saying, at first place, i was not inside the car when he hit my door, but i was halfway through, and then he said: But what is the difference if he was inside his car? he did contradict himself during his statement.
    I did suggest my insurance to listen that recorded phone call again, to better understand the liabilities, my insurer said they can't listen the recorded phonecall now...
  • You opened your door into the traffic. Whether you were inside or outside you should check its clear before opening the door.

    There was something about this recently, a country teach drivers to open the door with the wrong hand which forces them to turn and look to see if traffic is approaching.
