ECP parking fine

Hi and thanks in advance to anyone who helps with this thread.
So my wife has parked at this ECP car park for over a year normally between Mon - Thurs for 3 hours costing £2.30 and was always back before the time period ran out. About a 5-6 weeks ago she parked there for the first time on a Friday and paid the usual £2.30 for 3 hours parking only to recieve a Parking notice saying she had overstayed by 41 mins. She wrote to ECP telling them exactly that and didn't really understand what had happened to cause this issue. She later found out that on a Friday and Saturday the fee for 3 hours is 20p more ( £2.50 ) but failed to see this on the sign and had no idea the payments would change on different days of the week.
ECP refused to accept this explanation even though they have acknowledged she did pay £2.30 on the day ( not £1.50 the cost of 2 hours stay ) so she has appealed through POPLA.
It is so obviously a genuine mistake and has really annoyed both my wife and me that this has happened and that they do not seem to accept this and feel it warrants a £70 fine, she actually paid 70p more than was required.
Anyway we await the outcome of the POPLA decision and just wondered if anybody had any advice.

    It's a bit late to ask! Your appeal was on the wrong foot/wrong tactic and can't win.

    We would likely have helped you win the appeal, but too late - that POPLA appeal will lose.

    You can't win by talking about a mistake, not noticing the sign, and that the fine is unfair/high.

    Sorry about that, but it doesn't matter and doesn't mean you pay - at least you are ready for the likely email from POPLA! It's only ECP, ignore them after you lose the appeal. I've ignored them myself, before POPLA existed.

    Go there now to understand the game you are now involved in (and the errors you have made already!)


    You are going to have to wait out the debt collectors stage and see if they go for legal action - all covered in the FAQ

    as above, there is no way on this earth that POPLA will uphold your weak appeal based on mitigation

    had you come to us earlier we could have helped and the chances are this would have been won on appeal using legal arguments , including poor and inadequate signage

    but the good lady blew that chance when she went gung ho without seeking advice and so its potentially 6 years of hassle now , mainly from debt collectors

    if your family get any more, tell them to come here for advice FIRST
