Dishwasher broken down after 2.5 years

I need advice on the following:
My Electrolux dishwasher broken down after 2.5 years. This appliance came as part of the purchase from a new build home from the builder.

I am trying to find out if the appliance's 6 years lifespan expectation as mentioned by The Consumer Right Act 2015 is attached to builder or the retailer where builder have purchased the dishwasher from?

I have been filling a dispute against the maker Electrolux and was told it is not apply to the manufacturer but to where I bought the appliance from. Clearly I bought the house from builder, and the appliance come as part of the purchase.

I am looking to take the case further therefore please can you advise if The Consumer Right Act 2015 is applied to the builder or a third party where the builder bought it from?

The Consumer Rights Act 2015 :
"says goods must be as described, fit for purpose and of satisfactory quality. During the expected lifespan of your product you're entitled to the following: up to 6 years, If the good do not last a reasonable length of time you may be entitled to some money back."

Anyone can advice on this?

    The CRA 2015 does not cover house purchases, so basically you have no consumer rights for your built in appliances. You paid your money to the builder so you have no claim against either the retailer who sold them the appliances or the manufacture.

    Having raised it with the manufacturer they seem to be sticking with their position in law, so your only option is to ask the builder if they will make a contribution towards the repair.
  • The CRA 2015 didn't come into force until October 2015, so wouldn't be applicable anyway.

    You could ask the builder to get another one for you cost price, when I broke the hob, our builder did that for me. It is surprising how cheap all the appliances actually are.

    There is no expectation that all items covered by CRA 2015 should last a minimum of 6 years, only that you may seek redress within 6 years from date of purchase. Many clothing items will not last 6 years and 4/5 years is becoming the norm for many electrical goods

  • It's also worth remembering that if the builder was deemed to be liable, they could insist that you prove that the fault was due to a manufacturing defect and that it didn't fail because of something you did.
    Even if you provided this proof, the builder could then give you a partial refund as by now you have had 2.5 years use of the appliance and the refund can be reduced to allow for this usage.

    One other problem would be working out the value of the dishwasher at the time of the house purchase.
    If the builder bought a job lot of kitchen appliances at trade price and this was the price that was used when calculating the cost of the house, any refund you might possibly get now may only be a fraction of the cost of a replacement.

    Personally, if it was me I would forget about trying to get something from the builder and just call a couple of repair companies to see what they will charge to fix it.
