Builder pulled out of renovation midway through

Hi,

We're having work done on our house and the builder has just left the job due to illness. Our house is a building site, with no exterior wall at the back.

Anyone know what our legal position is? Or if we rely on his insurance in some way?

He's suggested his 24 year old deputy take over the job but we're obviously worried by that.

Any advice welcome!

    What form of contract have you signed?
    What did it say?
  • It was an implied contract. We gave him a bill of works, he gave us a quote and then work started. So there are no terms to refer to. Still operates as a binding contract as I understand it?

    You have to negotiate on this one. You have a right to expect the builder to be competent, but how do you prove competence, or even specify it? If the illness chap says the 24 year old is competent then you have to ask competent in what? If you are unhappy with the answer then you need to talk.


    If the chap is genuinely ill what do you expect as a satisfactory solution?


    Without any written contract you are in a weak position over this. Yet another reason why this forum has been telling folks for as long as the world has been spinning to get things in writing.
