Unknown CCJ (not my name) - ADVICE PLEASE

Hi all,

I am saving for a mortgage and i am cleaning my file up, making sure all is in order etc

I've found two CCJ's which i need help on

My name is Dominic and there is a CCJ for someone called David who i have never heard of. How do i go about getting this removed? as its not even in my name

Secondly, there is another CCJ in my name (although it says Dom not Dominic) i have no knowledge what this is for or when it happened (shows as 2013 issued). Now don't get me wrong, i am not disputing the amount owed (£400) although i cannot remember what it is for but i had no correspondence about this so whats the best way to go about it?

Do i pay it and settle it or is there a way i can get it removed?

Just looking for some advise

I have Noodle and these do not show on there but i recently signed up to a free trial of CHECKMYFILE which gives you reports from experian / equifax / call credit and both of these show on the EQUIFAX tab

  • Raise a dispute with the CRAs it appears on.

    Check Noddle (not noodles), Experian and Equifax individually, rather than Checkmyfile.
  • It's worth disputing with the CRAs, but it may be worth going straight to the court/Registry Trust ltd and querying it with the case number. Chances are all you'll get back from the CRA is 'you need to contact the court/RTL'.

    I was with them previously but left so my 30 day free trial has gone. Is there any other way to dispute it with them other than signing back up for £14.99 a month?

    Also, any advise on the second part of my post in regards to the CCJ i was never informed about?

  • As far as I'm aware, they do not need to make contact with you if they have tried to. It sounds to me like it was awarded by default due to non-appearance at court. As mentioned, the only way to find out more information would be contact the RTL or the court that judged the CCJ. Do be aware as well that the CCJ stays on your report for six years from judgement date, even if it's paid off.

    The CCJ you "agree" with cannot be removed by simply paying it off now. (It will remain the 6 years, though will be able to get it marked as "satisfied" after you pay it off in full - though most lenders still see it as detrimental to your application for a loan)

    Can't advise on the CCJ, but you can now get free access to all 3 of your credit files. Explanation here. For Equifax you need to be looking at Clearscore, as that's the free one.

  • I have checked Clearscore and it doesn't show the one under the name David, it only shows the one named Dom
  • As previously posted, you need to get in contact with either the CRAs to dispute it, who will then tell you within 28 days to go to the RTL/court, or go directly to the RTL/Court. There's literally nothing else you can do. If you can get the case numbers from your credit report, be prepared to give them to the RTL/Court so they can look further into it for you.

    The credit reference agencies will get their information about CCJs from the Register of Orders, Judgments and Fines. You can check that yourself here www.trustonline.org.uk for a small fee. If a CCJ in someone else’s name has been added to your credit file you should be able to have it removed by complaining to the credit reference agencies who have recorded it.

    A CCJ in your name, where you do not dispute the debt, cannot usually be removed from your credit file. It will remain for 6 years (from the date it was made), although if you pay the debt in full the CCJ will be marked as satisfied.

    When you contact the claimant to pay the debt you may want to find out more about the debt in case you do have any grounds to dispute it. If you choose to pay but can’t afford the full balance you can apply to the court to set up a payment plan, you can find the process to do this explained here https://www.nationaldebtline.org/EW/factsheets/Pages/varyingpaymentsonaccj/instalmentsonaccj.aspx.

  • Why didn't you respond to the initial court letter about the judgment case that is in your name? Have you moved address for example?
