I would be looking for an opinion on whether the effect of the matrimonial arrangement under French law is the equivalent to an English trust under which someone else (the ex husband) has a right to live in the property for life or a right to the income from it. If so, the property would not count against the wife for 3% surcharge purposes. See Finance Act 2003 Sch 4ZA.0
