the shoe repair shop has lost my shoes

sounds like the start of a bad joke....
the shoe repair shop has lost my shoes, where do i stand?
but sadly it's true.
they give tickets when you take them in for reheeling or repair, which state "no ticket, no return"
however, went to collect my shoes and they have given them to another customer by mistake.
this was over a week ago.
they have told me they will "look out" for the customer through the window in case they pass by, but clearly this isn't acceptable.
they have said i must wait 30 days.
i suggested waiting a week was fair, i have no shoes for work and don't think it ia acceptable that i pay for more in the meantime.
any advice??
I've heard of raising a claim in the small claims court but would like to hear any advice, thank you

  • Ian simpson. Are you daft? . They have given your property away and are trying to take the mick out of you. I would call them or go in and say if you don't refund or replace me for your mistake I will contact trading standards. Don't swear or shout but be firm.

    Bearing in mind that all they are legally required to do is to put the OP in same position as they would have been should the shoes not have been lost.
    This means that they don't have to provide a new pair of shoes of the same make and style nor do they have to pay enough money for the OP to buy a new pair.

    The dropped off a used pair of faulty shoes and all they have to provide is an equivalent pair or enough money to buy an equivalent pair.

    I wouldn't worry about what they are legally supposed to do, I'd push them for a good will gesture to cover the cost of a new pair.

    It's certainly worth trying for the full replacement cost but as this is the consumer rights forum, I don't see anything wrong in actually informing the OP what their legal rights are.

    No, mainly because Trading Standards do not take complaints from individual consumers, but also because even if they did they wouldn't be interested in a single error made by a trader.

    if your shoes were given to the wrong person, then that person's shoes must still be in the shop, so just wear them until you get your own shoes back.

    You never know, they might be better quality than your own.

    Aye, losing your shoes can be [STRIKE]soul[/STRIKE] sole destroying. ;)
  • Yeah, these people need bringing to heal, I'd be going in hell for leather, sounds like they've stitched you up.
