i am in truly precarious Situation and was wondering whether anyone has any advise.
i had a bad road traffic accident back in March, which has left me with 19 broken bones, extensive internal injury and some nerve damage. While i am set to make a full recovery, ii am not able to work yet, however when it rains it pours, so my landlord says he cannot afford this property anymore (no rent arrears from me)! so has sent a s21 notice, the council are aware and will give me money towards a deposit etc. however, even though i had been dealing with my creditors via step change one decided to go for a ccj.... which makes renting diffcult, even though am guessing that someone who accepts dss will be more lenient towards this sort of issue too... i was a working professional with earnings over 50k pa but no savings due to separation from my not yet divorced ex and even though he owes me money from the property we jointluy own, i cannot access this as i cannot afford a solicitor. i cannot provide a guarantor, and have 2 cats.

Was the accident your fault?0

Presumably you received a pay-out from either your own insurer, or the insurer of the other driver?
Is there any value in speaking to your lanlord and asking if he'd try to sell to another LL?
Letting agents tend to have rigid criteria, which you are likely not to meet, so try looking for private ads by landlords. They are often more flexible and willing to take particular circumstances into account.
As a last resort, the council will re-house you (B&B? so probably not your cats) afteer the bailiffs have evicted.0 -
Oh dear.
What stage are you at with the divorce, and what terms are you on with your ex? On a practical level, if your ex is able to advance you enough to cover a deposit and 6 months rent in advance that might be one option.
Another option might be for you to move back into the family home until financial issues have been resolved, which would save you trying to find somewhere to rent until you have your own funds.
You may be able to get a divorce funding loan - there are companies which provide litigation loans for people who are divorcing - they work on the basis that the loan is repaid out of the money you get for your divorce settlement, and you would, I think, have to sign to give your solicitors authority to repay the loan co. first out of the money you get from the house, but it may be a way that you can pay for proper advice. If not, then many solicitors will offer a free initial consultation and many can now accept credit cards also again, you may be able to pay and then clear you r card when you get your money.
You will find it hard to find rented accommodation - many BTL mortgages don't allow the landlord to let to a tenant who is reliant on benefits to pay the rent, and agencies will do credit checks too. You may find it is worth looking at smaller landlords who are letting directly rather than via an agency, as they may be more flexible in terms of their requirements. All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0 -
What happened to your job after the accident? It's nothing , not nothink.0

Tell us more about the CCJ. What did you do when the court claim came through the door?0

i love that my reply got lost....
1. accident was my fault and yes there was a payout but that was barely enough to buy a new vehicle, whch i do need for transport
2. i lost my job 2 week before the accident
3. my ex and i singed a separation agreement in which he was meant to pay a lumpsum '(less than what hed actually owe as i wanted to be 'realistic') in february this year, which he has not, pleading poverty etc.
4. i do not have family in the Uk
5. as for the ccj, i admitted it and offered £1 er month as advised by stepchange
6. yes council will help, but id rather not give up my cats....0 -

1. accident was my fault and yes there was a payout but that was barely enough to buy a new vehicle, whch i do need for transport - but why did they not pay out for your other expenses? Or do you mean that the total pay out was only enough, because that seems to be a problem - the value they pay for the vehicle is the value immediately prior to the accident.
2. i lost my job 2 week before the accident - ah, so nothing to do with the accident. BUT still you may, or may not, have rights. so how long did you work there?
3. my ex and i singed a separation agreement in which he was meant to pay a lumpsum '(less than what hed actually owe as i wanted to be 'realistic') in february this year, which he has not, pleading poverty etc. - well you can always move back in?
4. i do not have family in the Uk
5. as for the ccj, i admitted it and offered £1 er month as advised by stepchange - but did you submit that to the court??
6. yes council will help, but id rather not give up my cats....
I think you need to prioritise things in life now. Why do you need a car if you have no job?0 -
- no i can't move back in, i'd fear for my and my cats life....
- because once i'm well enough to work, which isnt that far off, i will need transport, and public transport unfortunately isnt an option anymore due to health conditions.0 -
as for the ccj - the claim form is sent to the claimant not the court, if it has been submitted i dont know at this stage...0
-
also, the value of the vehicle wont help. its not going to be enough to front 6 months rent or similar......0
