Debating on taking landlord to court

    I was under the impression that landlords only could be made to pay it back if it was paid direct to them

    You have so much ammunition with the lack of registration and deposit protection, I'd keep the HB out of it. It may backfire!
  • To be honest he hasn't touched the house in 4 years, No gas or electric safety tests and I had to apply to get a new boiler through a grant as his was pretty much condemned.
    Who ended up paying for the boiler?
    Might be wrong, but thought any grant application had to come from the owner?
  • I had to make the application and then get the landlord to sign off on it. No money was paid by the LL or myself. The nest scheme in Wales covered everything. I only got it because i was fed up of being left without heating and hot water for days on end.
  • Ok so abit of an update, Landlord has fessed up. He gave my bond to his wife who should of put it in the bond scheme etc etc.

    Cut a long story short he's sold me a sob story and now says I have all the power but he's still going to try and deduct money from the bond if the house isn't up to his standard.

    How do I go about disputing anything he tries to deduct from the bond? I don't want to get into a slanging match with him.

    bet his mortgage lender and hmrc don't know he has rented it out as it seems he isn't keep on following the rules


    I would get deposit back in full with no deductions and no work being done by yourself

    Send him a letter (get proof pf postage) stating that unless you receive your bond back in FULL within 7 days (give a date of 9 days after posting first class), then you will be taking him to court for 3X the amount due to his failure to protect it.

    -I'd certainly start by sending him an LBA about suing for up to 3xdeposit very soon: Might make him see sense over deductions.

    Parliament has - twice - debated the suing for up to 3xdeposit for landlords who ignore the law and approved it, the 2nd time giving the poor lambs more time (30 rather than 14 days) to do some simple paperwork.. Our own dear parliament has OK'd it, go ahead, it is your right!
