You do realise that you can't legally hold on to their passport in lieu of payment, all they would need to do is report the passport stolen and you'll be in deep doo doo. Also there's nothing to stop them from applying for a replacement. As collateral goes it's pretty weak.

I personally think the right thing to do in this case is:
1. Accept the return of the car and treat the sale as cancelled.
2. Keep the payments you've already had from the buyer (effectively, these can be seen as payments for them "renting" the vehicle from you).
3. Make sure registered keeper status is returned to you. And give back the passport.
If you are certain there was no developing issue at the point of sale, or you fancy your chances anyway, by all means go to court.0 -
I feel no need to justify the degree of how well I knew them. I kept something as collateral because there was obviously a risk of them not paying as you never really know anyone 100% as it is I was correct in being cautious, for the same reason I had the contract drawn up.
They're not budging on the following payments so for want of a quiet life I'm going to allow them to bring the bloody car back. I'll be returning the passport also. I think I'll break down the car for parts and then scrap it. Theyll have to pay to have it towed to my property and itll still be taxed and insured whilst ita here as they've done so and it will still be in their name until the DVLA switch it back. Never selling a car again.

If you do take it back, deduct a daily hire charge for an equivalent car.I do Contracts, all day every day.0

Once they've done an online transfer back to your name they can quickly cancel the tax and insurance. Be careful and don't assume the car can sit in a public area without risk. As soon as the car is back in your name, take it off the road and SORN it.0 -
The Tax will cancel automatically under a transfer of Registered Keeper.0
