Sold as seen buyer wants to return

    The buyer has now gone through their paperwork and there is a receipt from January when the c.f. boot was done that says "suspect head gasket". The garage didn't do a compression test and write this on all MGs who's head gasket have not been done as they're know for them being a problem.

    Hmmm, there is more to this story than meets the eye.


    It looks as if you knew there was a potential problem.

    This could go any way and holding on to his passport has the ring of a loan shark about it.

    Your account has changed significantly from the original. At first this was someone you knew well from school and now it's someone whose passport you've confiscated in case they didn't pay?

  • I personally think the right thing to do in this case is:

    1. Accept the return of the car and treat the sale as cancelled.
    2. Keep the payments you've already had from the buyer (effectively, these can be seen as payments for them "renting" the vehicle from you).
    3. Make sure registered keeper status is returned to you. And give back the passport.

    If you are certain there was no developing issue at the point of sale, or you fancy your chances anyway, by all means go to court.
  • I feel no need to justify the degree of how well I knew them. I kept something as collateral because there was obviously a risk of them not paying as you never really know anyone 100% as it is I was correct in being cautious, for the same reason I had the contract drawn up.
    They're not budging on the following payments so for want of a quiet life I'm going to allow them to bring the bloody car back. I'll be returning the passport also. I think I'll break down the car for parts and then scrap it. Theyll have to pay to have it towed to my property and itll still be taxed and insured whilst ita here as they've done so and it will still be in their name until the DVLA switch it back. Never selling a car again.

  • If you do take it back, deduct a daily hire charge for an equivalent car.
    I do Contracts, all day every day.

    Once they've done an online transfer back to your name they can quickly cancel the tax and insurance. Be careful and don't assume the car can sit in a public area without risk. As soon as the car is back in your name, take it off the road and SORN it.

    The Tax will cancel automatically under a transfer of Registered Keeper.
