ES Parking solutions disgrace!

I recently received a final demand for 125 pound from ES Parking Enforcement Ltd. There is no right to appeal as it is over 21 days since issuing the fine (according to the appeals section on the website....) however, this is the first letter I have had, completely out of the blue. It states that they have written to me previously and I have still not paid. They haven't.

Also it states I must pay in 14 days. The letter was dated 9 days previous to me receiving it? Essentially giving me 5 days to sort it out as it is a 'Very serious matter....'

I can only assume the parking ticket slipped from the dashboard or something because I always pay. Anyway, I am stressed out because there is no way of contacting this firm (apart from to pay of course...) I can't tell them whats happened or start the appeals process.

Because I can't start the appeals process aI can't get the 10 digit code needed for an independent appeal through POPLA. I would have paid the original amount and took it as a lesson had I got the original notice but I didn't. Now my wife is really anxious and I am considering my options-please someone help me!!!!

    You've had two attempts at telling us which parking company you're dealing with, but they're (slightly) different names. There are so many parking companies with very similar names, accuracy in telling us which one is essential.
    Because I can't start the appeals process aI can't get the 10 digit code needed for an independent appeal through POPLA.
    I'm guessing it's the latter company named (ESPEL), if so they are members of the IPC AOS and as such POPLA is not open to you.

    Please read the NEWBIES FAQ sticky, post # 3 which tells you about the IPC's second level appeals service, the IAS, and why we recommend not appealing to them.

    What is concerning is the refusal of ESPEL to allow an appeal to be submitted in the circumstances you describe. So please formulate a complaint to David Dunford of the DVLA and ask him to investigate. The complaint should be about ESPEL's refusal to allow an appeal to be made, not about your parking charge per se or the circumstances in which it was incurred.

  • Hi Thanks for the swift reply-the letter is headed ES Parking Enforcement Ltd sorry about the confusion. Just for clarity they have not technically refused to let me appeal-the process prevents me from doing so if that makes sense?

    There is an appeal process which I guess you engage with after the first letter but I never got a first letter-first thing I knew was a threatening demand.

    If there's no appeal open to you, you can sit back passively and just wait to see how far they take this - debt collector letters (ignore), quite possibly a LBCCC followed by court papers (do not ignore).

    Or you can be more proactive with a complaint to David Dunford and show ESPEL that you might not be an easy touch to deal with, in which case they may move to pick off more low-hanging fruit.

    Nothing is guaranteed in this advice, ultimately how you handle it is your call.

    Have you complained to the landowner (you haven't said what kind of car park it was) and ask them to intervene and get this cancelled? Works well with retailers, retail parks, hotels etc, rather than some bomb site lot that ESPEL seem to infest.

  • Bomb site lot in Liverpool. I have emailed David Dunford in the meantime. Seems like this company are real shysters- final demand sent out, threats of court, no appeals process and no way of contacting them-what a mess.
  • Turns out David can’t help me. He said that the DVLA can’t help in instances where letters had been sent or received? Seems like no one is prepared to hear me out!

    All appeals would have been futile anyway, and you would have been left in the wait and see stage


    (If it comes to court the judge will hear you out)

    Do the above, then. If no landowner to moan to, ignore the scam and come back if you get a claim.

    At least you tried. Eventually, if sufficient numbers complain of the same issue, the penny will drop in Swansea and something might be done.
