  • Excellent story, I wonder if there was a question over Gladstones' representatives "Right of Audience"? If there was, then none of the details of the purported claim would have been able to be entered into and therefore the case dismissed.

    I didn't raise this (Right of Audience), although it was a question I had noted previously.
    In all honesty, I had overlooked this and how to present the argument in my final preparation.

    I know everyone has said it before, but I really was surprised at how unprofessional Gladstones approach was.
    One of the key things I had identified in my WS was that they never sent me the Bundle and I didn't get their WS until 5 days after the due date (5th Jan). I had chased this up twice by email and eventually had an email back on 12th Jan stating "We maintain that our Witness Statement was sent to you by first class post as of 03 January 2017". The actual WS that arrived in the post was dated 4th Jan.....:think:

    They had also stated that the letter I sent (requesting information and clarification), in response to their LBC was irrelevant and I should have addressed this issue through the Claim Form......which obviously hadn't been issued at that time! :huh:

    Having gone through this process, I completely understand why you guys are so committed to helping people to fight against these crooks. It is so frustrating (yet understandable) that so many people get frightened by their letters and demands and put money in their pocket without question.
