So i've just submitted my AOS. I assume now I start my defence and submit it online? Does it have to be legally worded? I have taken better pictures of the rubbish signage etc..
Its all abit confusing...
Thanks
Have another look at the post immediately above yours and read the post mentioned there.
There are many links to defences and sample layouts are shown.
In fact all your questions are answered there.0 -
Yes it has to be properly set out with headings and in the third person from you as 'The Defendant'. Luckily you have examples to copy from, in the NEWBIES thread; we don't want you to write it from scratch. And no, it is not submitted online on MCOL.I assume now I start my defence and submit it online? Does it have to be legally worded?
Good, but you will know from reading the NEWBIES thread that evidence/photos are not filed yet.I have taken better pictures of the rubbish signage etc..PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

thanks for the help and info. One last thing. Do i need to complete the defence form now or should I do this when I have my defence draft? I didnt want to click on the option and be asked for information I don't have to hand.
Thanks0 -
What 'defence form' are you talking about?thanks for the help and info. One last thing. Do i need to complete the defence form now or should I do this when I have my defence draft? I didnt want to click on the option and be asked for information I don't have to hand.
Thanks
Have you read this Bargepole thread?
It's linked from post#2 of the NEWBIES thread.
In there you will see detailed guidance on what you are trying to do now.
In particular:Do NOT put anything in the 'Defence and Counterclaim' text box, not even a full stop.
You really need to read the whole of that post before doing anything else.0 -
Many thanks. I didnt spot that. Time to get prepping and write up everything.
At no point have I stated who the driver was as all correspondents from Sip and gladstones have been asking me to give the drivers details. I'm I right in thinking that in my write up I still do not give details of the driver and argue that I'm not liable being the registered keeper? Also at any point now or in court do I legally have to say who the driver was??
Thanks again0 -

Just a Gladstones try on ????
YOU ARE THE REGISTERED KEEPER .... NEVER THE DRIVER0 -
It's up to you, depends on what your defence is about. Some strong cases are much better argued by the driver, and it's easier to stand up at a hearing and explain as driver.I'm I right in thinking that in my write up I still do not give details of the driver and argue that I'm not liable being the registered keeper?
Well noooo...but if a Judge actually asked, you'd find it hard not to answer and would look like you were hiding material facts. Decide now how you will handle this. SIP Notice to Keeper letters are fairly compliant with the POFA aren't they (or did you never get one?).Also at any point now or in court do I legally have to say who the driver was??PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I never got a POFA. I suppose I'll argue as the driver. It's actually my partner's claim but I'm trying to sort it for her as she's stressed out.
I have afew days off next week so I'll get this all written up.0 -
This is, in effect, a claim over a 50p underpayment. Surely the Law does not concern itself with such trifles. You never know how far you can go until you go too far.0
-
Exactly. All this over a 50p underpayment. It's not like most of us have better things to do. All it would have taken is a simple note to say she had underplayed and she would have payed the extra 50p.0
