Hope someone can help...

Back in 2014 a car hit into mine without stopping. I was not at fault. I lodged a claim with one of the no win no fee lawyers and it has been dragging on since. The defendant has denied being in the location of the accident.

I have now received a court summons to a County Court. This has surprised me and if I could I would withdraw my claim but my lawyer says that if I do this, I will need to cover the legal costs incurred to date.

What are my options? Last thing I want is a County Court Judgement. I do not want my credit profile to be impacted. Would a CCJ arise from this even when I do not owe anyone? Please help......

Is this a claim? (County Courts don't issue "summonses")


If it's a claim from the third party then pass it to the insurer at the time of the incident to deal with

As far as I understand, it's not a claim. The defendant has issued the summons for me to attend court. My lawyer passed the summons on to me

In that case it looks like you have issued court proceedings (via your lawyer) over settling your claim.
(You won't end up with a ccj by attending court)


You will have agreed to assist your lawyer by attending court if necessary when signing your agreement with them originally


Get them to explain to you what this is all about

Is this normal for the claimant to be summoned to court? I thought the power to summon lies with me the claimant?

Presumably the other side want to question you in front of the judge about the incident as they are disputing liability.

Quite normal.

But do get this fully explained to you by your lawyer.

Has your solicitor sent you a copy of a County Court Claim Form? Does it say N1 on the bottom left of the claim form?

If so, are you named as the Claimant or the Defendant on this document?

Yes, my solicitor has sent me a copy of the County Court claim form. Bottom left says N154. I am named as the Claimant
