Countrywide Parking Management Ltd - Accidently Told Them I Was Driver
Comments
-
April 2017, I was parked in a office block in Southampton. No PCN was left on the windscreen it was sent to me via the post but all the photos were taken by someone, not by a CCTV camera, i was most surprised! Why wouldn't they just put the PCN on my windscreen?
I have appealed it to both Countrywide Parking and the IAS but both have been rejected.
P.S I am a real user - I was trying to find out if anyone else had been taken to court by them when I come across this post.0 -

Whatever the current status they have 6 years to take legal action against you0 -

If you have received court papers you need to start your own thread for advice.0 -
Hi I don't know if anyone can still read this thread but I've received a letter before claim from BW Legal, I did send back the forms saying we'd pay but can I change my mind and let it go to court? Even so I don't think we'd have a very good defence. Any advice? Just pay or try and put together some sort of defence when court papers come?0

Of course you can change your mind
In this LBC from BWL, does it give you proof of their claim
and give you 30 days to respond0 -
This is my own thread? Was told to come back once I get court papers but not sure if I want to get that far.
When it says proof of claim what do you mean? And yes 30 days to respond (probs 2 weeks in now)0 -
Over 9 months have elapsed since I linked you to the BMPA page which showed that this PPC had never proceeded to the small claims court - and despite that time gap, they still haven't.

I'd guess that this is just BWL ratcheting up the ante - you need to play the game and respond robustly as if you have received a LBC, as per the NEWBIES FAQ sticky, post #2.
I think beamerguy was asking if the amount claimed had been broken down into component parts, this gives you the opportunity, should it in the unlikely event get to court, to dismantle any spurious claimed costs. When it says proof of claim what do you mean?
Since Oct 2017, LBCs must follow a strict protocol. Does the letter you've received fully comply with the Pre-Action Protocol for Debt Claims (PaP)? If not, get back to BWL, in writing, and demand anything and everything you're entitled to under PaP. Check it all out here:

Make yourself difficult to deal with, then they might eventually look for lower hanging fruit to harass. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
