ANPR didn't park ?

Hi and thanks in advance ..
I used my ex Mrs car for a trip with the kids to Plymouth to see the fireworks display
It was very very busy . Entered lamb hay car park . There were no spaces . We stayed with the car . Not in a space as everyone was taken.. my ex just received a letter demanding money. This is the first she received even though it states discount period expired. The company is brittania. Where do I stand . Any advice thank you for. Just cannot afford this at the moment and she is worried that it can affect her credit rating also ?

    For goodness sale don't try that urban myth!

    Your credit rating is safe there are no automatic black marks for getting an invoice from silly scammers!

    That's called parking.

    As advised, this is now in the hands of the vehicle keeper. They can either appeal this as per the NEWBIES thread, or name the driver. If they do the latter, it is much harder for the driver to beat than the keeper, but not impossible.
    Ideally you want your ex to appeal as keeper and not name the driver.

    When you sat that you did not park, do you mean you drove around all the time? If not, you parked, but read this.

    .so this was an Anpr from a bpa company brittania so the letter template is this one ....?

    I challenge this 'PCN' as keeper of the car.

    I believe that your signs fail the test of 'large lettering' and prominence, as established in!ParkingEye Ltd v Beavis.!Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers.

    There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.!

    Should you obtain the registered keeper's data from the DVLA without reasonable cause, please take this as formal notice that I reserve the right to sue your company and the landowner/principal, for a sum not less than £250 for any Data Protection Act breach. Your aggressive business practice and unwarranted threat of court for the ordinary matter of a driver using my car without causing any obstruction nor offence, has caused significant distress to me.!

    I do not give you consent to process data relating to me or this vehicle. I deny liability for any sum at all and you must consider this letter a Section 10 Notice under the DPA. You are required to respond within 21 days. I have kept proof of submission of this appeal and look forward to your reply.

    Am also a bit confused as I read the other link earlier on thread .. the truth is we didn't park.. the car park was stacked full for hhe fireworks night . J and possibly four other cars were waiting for spaces..
    I also realise that this may not and does not matter with reference to the template letter..

    No. Never speak to the PPC!


    The keeper should be sending the appeal, not you, and the keeper should have received all other correspondence, not you!
