Faulty Wardrobes

Hi, just after some advice.

We purchased 2 wardrobes and 2 matching sets of drawers from a department store last year. Unfortunately one of the mirrors slid off the wardrobe door in the night and a fitter had to come out and fix it. The store contacted me last week and said as this had now happened to a number of people and it was a safety issue and so we had one of 3 options:

- To get the doors replaced free of charge
- To receive a refund for the wardrobes (not the drawers)
- To purchase more wardrobes from the store from a different range.

I think I am going down the refund route as I am not happy with the safety issues of these wardrobes. I have asked the store if they would refund the drawers too as they were bought as a matching set. They have refused as its only the wardrobes that are faulty and not the drawers. Problem I have now is that if I buy new wardrobes they are not going to match the drawers. Wasn't sure if I could demand a refund on both the wardrobes and drawers? Is this unreasonable?

Any advice appreciated.

Kind Regards
Nicola

If the fitter has repaired it, whats the issue?

If there is none, it sounds like the store are offering goodwill so consumer rights don't come into it.

However since you seem to have had a repair, if the goods still failed to conform after that repair, you would have the right to reject which comes with the right of partial rejection. Namely that you can:

    1) Reject all the goods
    2) Keep all the goods
    3) Reject the goods that dont conform and keep the goods that do.

But be aware after 6 months from purchase they can make a deduction from the refund to account for use you had of the goods. With that in mind, perhaps accepting their offer for a refund on the wardrobes (if its a full refund offer) and trying to sell the drawers privately yourself might give you a better result.
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride
  • By your own admission there is nothing wrong with the draws, so no you can't.

They have also offered to replace the doors. They are meeting all their obligations.

They have offered to replace the doors free of charge. Their obligation stops there.
  • Update! As the drawers match the wardrobes they have agreed to giving a full refund for everything. Excellent customer service.

    Thanks for all your advice!
