Just a quickie from me as I'm done, putting my iPad down, and off up the wooden hill.
I'd open your 'Grace Periods' appeal point by moving to the top of it the actual circumstances of the day shown towards the end of this section - and then pile in with the other stuff about the BPA CoP etc. Just in case the assessor is skim reading (not sure how they get through their day dealing with pages and pages of internet copy and pastes without skirting over the details) and misses the detail that underpins your position.
I've not read further down your appeal. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thanks appeal amended to put the detail right at the top of the first point.
My main question is, is point 2 relevant if PE included the POFA paragraph on the NTK?
Thanks0 -
Did they meet the requirements?
Basically, did it arrive within 14 days of the incident?
If YES then I would remove it, as their NtK are compliant enough in the other requirements.
If NO then leave it in, but you must MAKE IT CLEAR that it was not recieved within the required time.0 -
Great news my appeal was successful. Won on the grounds that they didn't apply the correct grace periods.
Interestingly they also said that as the parking ticket only had the time the ticket was purchased on that is was reasonable for the driver to assume that the parking started from that time.
Thanks for the help everyone.0 -
Hiya, great to see you were successful! I have appealed a PCN as actually was only in the csrkatj for 11 minutes and chose not to stay for various reasons. Based on lots of advice on here I haven’t told them the driver however they won’t issue me with a POPLA code until I give them this information. Is this allowed? Apologies if I’m not supposed to write on this thread.

Re-read what they actually said and then wait patiently for your PoPLA code.
If you would like further help or you have more questions then please start your own thread. Trying to progress two people's issues in one thread can only lead to confusion.
Oh, and what is a csrkatj?0
