We have a 2 year old son, I work a 39hr week mon to fri. Shes currently unemployed and looks after him allweek.
We got married in march but now I think a divorce is the only way forward(shes slept with someone else) we brought a house in 2015 I put down about £37k paid all stamp duties solicitors fee's ect.. But she wanted her name on the house as security which we did but I took advice from some friends and set up a declaration on trust as tenants in common which shows i'd keep first £37k and then split the difference 80/20% in my favour.
our house is worth now 180k according to zoopla we paid 145k 3 years ago and have 100k left on the mortage
obviously before we got married I think if we split I could have brought her out and be end of.
we will share our son going forward alternative weekends and we'll have to sort out week nights with work.
we own 1 car worth apprx 4k and I have 10k savings shes has none.
how do you think the finances will be split after divorce. I understand our son needs 2 family homes.

Which is it? Do you want a divorce or to work through it?0

After reading his other thread, I think that whilst hoping for a reconciliation and barring a miracle, he realises that divorce is pretty-much inevitable.0

How a court will split the assets will depend on what a court sees s fair. They take into account the length of the relationship, not just the marriage.
A court would probably take into account the declaration of trust, particularly if this was entered into after you already had children and if at the time it was signed you were either married or engaged, but they don't have to follow it completely, and they would have to take into account your wife's needs and the needs of your child. All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0 -
PS - you can't start divorce proceedings until you have been married for 12 months. But you could separate sooner, and divorce once the 12 months are up.All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0
