SDP Advice please

Hi folks

I am currently still receiving SSP from my employer, due to my condition i will not be returning to work after the 28 week SSP entitlement runs out and i believe i will then move on to ESA payments,
this week i was awarded PIP at the higher rate for both daily living and mobility, i have been advised that i will qualify for Severe Disability Premium because of my PIP award , what i was wondering will SDP be back dated with my pip claim as i was unable to claim it before my pip award or just from the day i apply for SDP.

Hope that all makes sense and is correct im pretty new to this and still finding my feet.

    The criteria for SDP is you live alone (no non dependants living with you) and no one claims carers Allowance for you and you claim Income related ESA ONLY. If this is the case then you'll be able to claim it once you start claiming ESA.

    this is not the case i do not live alone and have 2 kids still in full time education we do not get carers allowance, it seems i have been misinformed i am glad i asked the question.

    If you don't have a partner and you still recieve child benefit for your children then you're classed as living alone. If this is the case and it's Income Related ESA that you'll be recieving once you start ESA (the premiums are paid with Income Related benefits only) you'll be able to claim SDP. If you're eligible for SDP then this will be paid when your ESA starts and isn't payable while claiming SSP.

    I will just have to wait and see what happens when i start claiming ESA.

    Yes indeed you were miss-informed. SDP is very complex and the criteria is very strict. Living with your partner you won't be eligible for this premium. Claiming ESA would depend on your NI contributions in the last 2 years for Contribution Based ESA which is payable for 365 days unless placed in the Support Group. You wouldn't be entitled to Income related ESA because your partner works full time.
  • i am really misinformed then regarding ESA if that is the case i was told i would definitely get some form of ESA when my sick pay runs out( this was my social care worker who told me this) as i cannot claim job seekers or return to work,as for national insurance contributions i have paid them since i was 16 years old just short of 30 years without any breaks in my work history up until June this year, i think I need to speak to someone in my social care team again or maybe C.A.B as i have been clearly ill advised .

    As you've paid you NI contributions for all those years without a break as i said in my above post you'll be entitled to Contribution based ESA. This is paid regardless of how many hours your partner is working because you paid your NI. This is only paid for 365 days (1 year) unless you're placed in the Support Group, then it's paid for as long as you remain in that group. The weekly amount is £73.10 at assessment rate. It's the SDP premium that you won't be entitled to.

    Thanks again a year is better than nothing now i have PIP if we stay thrifty we will survive. i am pushing hard with my recovery i have physio practically every day at the min i just need to get back on my feet and back to work in whatever capacity and put this nightmare behind me .

    My mistake was only putting plans in place for the event of my death i had no plan for surviving,
