  • Told "we would need hard hats and they didn't have any available" when it came to an inspection is something most of us would believe.

    It's only clear in hindsight that they were thinking up an excuse as to why it wasnt possible to view that garden and that was the lie they decided to come out with.

    Warning bells should have rung when they said "excuse excuse - as to why you cant see it" and insisted "We WILL see it right now. You WILL provide hard hats right now. We're going no further on this until you do" - but I can see why OP believed this "lie of convenience".
  • We were told, and the plans show, 2 steps and a slight incline to the overall garden. What we got was 6 steps and a 4ft steep slope, along with a bannister and a safety fence. We were told that our house and garden was complete and we moved in. At no point did anyone tell us they were coming back to install a two tier retainer wall. This was an afterthought by persimmon because so many people had complained about the gardens. Persimmon unilaterally decided to go ahead and install one in our garden without our knowledge or consent.
  • Is there a chance you could have them for trespass and criminal damage if they don't put things right? After all - they were in your garden without your permission and basically vandalising it.

    What does the planning have for this part of the estate.
    They would have to have considered the slope for things like rain run off.


    A slope like that would have been fairly obvious from looking at the site and not just a couple of steps.

    Really...? A large building site, and no hard hats available for site visitors?

    It's not! Trespass is a civil offence and Persimmon were not doing criminal damage, just trying to rectify the problem. I'm no fan of Persimmon but it does seem they are/were trying to find a workable solution.

    What has happened to the gardens of the other houses in the row?

    Surely a "workable solution" should have been workable for both parties or at least have been run past us first? Especially when there's going to be an ongoing cost we would have to take on. Also, they did enter our property illegally and without our consent. That's trespass.
