Driver got a ticket last night in Hereford

https://imgur.com/cROg3ZL

The location is a parking area outside the front of a shop.

The vehicle in question was a hire vehicle so it needs to be dealt with before they go via DVLA for details.

The background to the vehicle being there is at the time it was involved with moving equipment into the building opposite and installing it.(it is a narrow lane so impossible to leave the vehicle on the road after unloading)

The owners of the building that the driver was working in had obtained permission from the shop owners to use their parking area for the vehicles. At the time of the 'offence' the shop had actually closed for the day so no customers were inconvenienced.

The offence on the ticket is 'Not using the venue at the time of parking'

ETA

Not sure whether this was issued on behalf of the council as their website seems to indicate that they do work for them

Get the land owner to have the PCN cancelled. Seems the most logical in your circumstance.

Before starting a new thread everyone is politely asked to read the newbies FAQ thread near the top of the forum.

Go there now for advice on how to deal with this.

Hire car issue is covered there.

The ppcs do monitor this forum and can use your posts against you.

Edit your OP to remove details of who was driving

You have received a private parking charge, not a proper council fine

Ill give that a go. Will need to look him up in the phone book ask live 80 miles away. Hope Google maps are good enough to give me a shop name.

Do follow the advice in the Newbies FAQ thread - complaining is covered there.

But in tandem with complaining to the landowner you need to follow the timescales for appealing.

Keep following the appeals process whilst awaiting the outcome of the landowner complaint, and don't give up on appealing till the PPC cancels the charge in writing should you be successful with the landowner

I'll need to begin to the land registry to find the land owner. Shop manager says they lease and only have control of the parking area during shop hours. Outside that it's the land owner. It's only a 10ft wide strip between the shop front and the road

This can be beaten at POPLA as CSPM are BPA operators. Do your research well @OP and you will get rid of this.

Currently, have never issued legal proceedings to pursue a parking charge.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

As it's a BPA firm it is easy enough to win at POPLA in most cases - see the NEWBIES thread.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:
Home»Motoring»Parking Tickets Fines & Parking - read the NEWBIES THREAD
