I have read as many threads as I can, and used the search facility to see if there have been any similar instances, but I can't find any.

Unfortunately, I only arrived here after already appealing against the PCN, I know I should have checked here first, but I was convinced they would overrule the 3 parking tickets, I was wrong.

I have purchased an apartment at the Lakeshore Drive complex in Bristol, and also purchased a car parking space. I was given a permit to display, which I did sucessfully for the first few weeks after moving in. I commute by bus into work, so hadn't been back to my car for a few days, when I did I found 3 tickets from Link Parking Limited, for the reason of not displaying my permit, which I found on the passenger seat. It had fallen off the windscreen.

They replied with this
Further to your email appealing your PCNs.
The vehicle was parked in a manner which attracted a charge as it was parked whilst not fully displaying a valid permit. It is the drivers responsibility to ensure they meet the parking requirements. Our signs clearly advertise the parking requirements and by not meeting them you accepted our charge.
Given the facts we are rejecting your appeal.
If you believe this decision is incorrect, you are entitled to appeal to the Independent Appeals Service (IAS). The IAS provides an Alternative Dispute Resolution scheme for disputes of this type. As you have complied with our internal appeals procedure you may use, and we will engage with, the IAS Standard Appeals Service providing you lodge an appeal to them within 21 days of this rejection. For further information please visit https://www.theias.org.
If you appeal this charge then you will lose the ability to pay the reduced rate in the event the appeal is unsuccessful, the full amount will then be payable. If you appeal and subsequently pay the charge prior to that appeal being determined then the appeal will be cancelled and you will not be given a further opportunity to


I have no idea what to do next, please can someone point me in the right direction. I purchased my parking space for £10,000 and am rather peed off that I have been ticketed, do I need to pay it or not? As I jumped the part where I should have waited for the NTK letter, I'm not sure what to do now.

    its simple , as explained in that NEWBIES thread

    DO NOTHING

    stop looking for something to do , they are in control , you are not and you will remain NOT IN CONTROL for up to 6 years

    as you paid for your space , you have primacy of contract (look it up) and look at all the other PARKING SPACE threads that explain all of this

    let a judge decide, in court

    you are the landholder and so you dont have to agree to their demands nor pay a penny, not unless a judge said so

    there are DOZENS of similar examples on here and on parking pranksters blogsite , where OWN SPACE or residential issues have come up

    if you are looking for something to do , think about sending LINK a cease and desist letter and a threat of an MCOL and an injunction for trespassing on your land

    Did you know that, before their toys were taken away in 2012, clampers used to rock cars, to dislodge permits? One wonders how this happened to you.

    Wait - you are the leasehold OWNER of that space?

    Why the heck are you displaying a permit AT ALL, and why are they trepassing on your land? You are the landholder and you have not asked or authorised them to charge you to park in your owned space - of course not.

    You need to opt out of the pathetic 'permit scheme' (NOW, URGENTLY), and tell your Managing Agent that you NEVER agreed to be charged for parking, you own and have title in the space. It is your demised property, so it should not be (and never should have been) included in the general areas that Link are marauding around.

    And while they are about it, perhaps the MA can explain why they've contracted with this notorious, extremely nasty and litigious firm, allowing them carte blanche to harass residents anywhere on site? And how can residents get them removed?

    Do NOT do IAS appeal, it is considered a kangaroo court and people lose, then get disspirited, even though it means nothing and the decisions are considered to be hugely biased (the IAS is run by the Trade Body, the IPC, who in turn shared common Directors until very recently, with Gladstones Solicitors...the ones who act for the PPC scum to sue people, after IAS cases are lost - hmmmm).

    However, when people stick around here (and don't just take advice, or a defence, and run), when the case comes to small claims hearings we help 99% of posters win their case.

    Yes you are likely to get a claim. Yes you are likely to win and even if you lost, there is no risk, no CCJ. And in your case I'd be looking to counter-claim for distress caused arising from the trespass on your space by the Link employee leading to unwarranted demands for money when you OWN the damn space!

    The urgent thing is to make it clear you did NOT agree to this 'contract' and that Link need to get off your land immediately, and 'go swivel'.

    Cite Roger Davy v UKPC (Winchester Crown Court 23rd January 2013) and tell the MA and Link Parking that you did not agree to any 'contract' and your space is NOT within the area that Link can set foot, or ticket. Nor will you or your visitors display any permit to use your own demised property and if Link continue to ticket you, then you will be forced to obtain an injunction to prevent them from this unwanted trespass, and will sue Link AND the Managing Agents for joint and several liability for your distress and the cost of the injunction and solicitor's fees, if you are forced to seek legal advice on this predatory harassment.

    Thank you again Redx for the extra info/links, I will be sending a stern letter to the MA.

    Many thanks Coupon-mad, I will get a copy of all the paperwork regarding the parking space from my solicitor and go through it with a fine toothed comb.

    I did notice on the parking signs, that it says

    PRIVATE LAND
    CONTRACTUAL AGREEMENT
    Parking in this area is permitted for:
    Vehicles displaying a valid parking permit and parked in the correct allocated bay.

    What it doesn't say it that the permit is to be displayed in the window, it was clearly on the seat and luckily right side up, but I didn't take any photos as proof.

    signage is what can and does form any contract on the site

    but as you either OWN that space outright , OR you have a lease on it or whatever, its yours to do with as you wish , depending what YOUR contract or deeds say

    it is unlikely that an MA or a PPC can override your deeds or lease, so get your paperwork out and see what legal rights you actually have

    as CM says , if this is your space, then WHY are you kowtowing to these morons at all ?

    the sooner you understand your legal rights the less it is about "what happened" and its more like DAVEY found out , a wake up call to the rights of the landholder or leaseholder over some idiot MA or scumbag PPC one man band

    Gladstones are conning Link to go to court over every ticket, Link lose just about every well defended case and Gladstones pocket their fees. Kerching! I'm surprised someone at Link isn't monitoring what it's costing them.

    Thanks for the links Panglos, very interesting read. I'm hoping it wont go to court, but if it does, it sounds like the outcome will be positive.
