"Yes it would be nice to have law/action that would allow PPCs to be bankrupted for their transgressions and their directors sent to prison...but that not going to happen."

but nobody has suggested that ?

"No access to DVLA data would be the death knell for many PPCs."

And that depends on what is meant by "no access"
A lifetime ban would be suitable but it will probably be the usual
2-3 months which a PPC can survive such as UKPC.
    No death knell

As the title of this thread says "Have we heard this all before?"
This was supposed to be sorted by the DCLG in April 2016
That went dead and the question is WHY ?

No wonder everyone is suspicious about future bills when the
government has allowed this scam for such a long time

Until everyone on this forum can actually see a draft of this bill
it is impossible to comment and whilst local MP's should be asked
to support it ....... support what ???? none of us know.

Their last attempt The POFA 2012 solved the clamping fiasco, but caused the escallation of threats, bullying, court cases and proliferation of fake PCN,s

All the promises of Eric Pickles meant diddly squat, its no wonder people are questioning this latest news.

Yes Brexit it big, bit the country isn't closed down for other business yet!

It is recognised, by sources in the corridors of power, that they got it wrong with Sch.4 of POFA, because they blindly followed the advice given by the BPA at the time.

This time round, they are listening to a much wider cross-section of opinion.

I'm not here to make excuses for the glacial speed at which Government operates, but can assure you that this Bill will be worthy of your MP's support.

The draft clauses probably won't be published until shortly before the second reading on 2 February, so you'll just have to take my word, as a poster of over 10 years' standing on this forum who has helped hundreds of motorists, that you should get behind this.

So please stop carping, and get writing.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

Bargepole, I have the utmost respect for you and indeed
your knowledge that has helped many.

I am not adverse to talking to my MP but at the same time,
I'd like to know what I am talking about

Fisherjim has made the point perfectly, too many people
have been hurt by this scam

Interesting though that they "blindly followed the advice given by the BPA at the time."
At least a finger can be pointed now

Not carping at all, and thanks for your insight we all know of your expertise and help given, it's just the inaction, ineptitude, and silence from government that makes people cynical. Coupled with the feeling that they have not admitted or ever do admit to getting anything wrong.

Of course if this really is going to sort the whole sorry mess out I think we will all be behind them no question.;)

The momentum is building. Scotland taking similar action.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Yes we will all be behind it and we can only hope they will
    address all issues

    THE CCJ PROBLEM
    DODGY SOLICITORS AND LEGAL FIRMS
THE TERRORIST CLAIMS BY DODGY LEGAL AND DC's

If the dodgy incompetent legals the PPC's use are not part
of any new regulations nothing will change as the buck
    will be passed onwards.

We have waited too long and we can only hope that a year
down the road this new bill will work for the millions of
motorists and not be detrimental as POFA 2012 currently is

    BRILLIANT

Smart Parking would not comment ???

How could they comment when they try their terrorism in Scotland

No one will forget their act of terrorism towards Tracey at
Fistral Beach. They are simply animals

But, there you are other PPC's, seems Smart are bursting
    your little bubble as well
