can estate agents continue to market if vendor not accepting asking price?

About a month ago I offered asking price on a house. The vendor refused my offer (I'd already made a few offers below asking price and he said he would take no less). I asked the agent, just out of interest, if he would give a figure - he came back with an amount about 15% over the price the EA is marketing the house for. They have told me there is no one else involved, no other offers on the table. I left it at that.

6 weeks later the ES are still marketing the house at the original price and still doing viewings, in the knowledge that they and the viewers are wasting their time seeing as the vendor will not accept anything less than 50k over the asking price. Can they do this???

    Of course.

    They may be willing to sell at asking price, just not to you.

    Mad seller, who thinks his house is worth a lot more, is insisting on holding out for the higher figure that he'll never get.

    The EA has a contract to market it - and while he has it, his competitors don't.... that's part of their strategy. It's worth them doing a few viewings, knowing they'll not get more, just to stop a competitor having it on their books.

    Some people aren't comfortable selling to investors. Too many games get played.

    Yeah I did think that. The irony is I'm not a developer - it's my dream home but I just found it a few years earlier than I thought. At the moment I'm in a different city and it'll be a couple of years at least before I can move. Have told the EA all this (not the 'dream home' bit of course) but it doesn't make any difference. They know I'm keen and it's been on the market for ages... I'm starting to think that the guy just doesn't want to sell. At what point does the EA give it up as a bad job?
