I rang the bailiff office at the county court spoke to a lady who said that she would send me a n245 form and she also said no one would call this week as the guy wasn't in and she will put note on my account that I'd been in touch and she was sending me a form..
Next I contacted PRA who said that they have emailed the bailiffs at the county court asking them to suspend any action until I get my form into them.
Firstly I want to know if you think this will help my case and stop them calling in the immediate future?
and also the n245 form if I can pay the fee via cheque? Sorry for all the questions, finding this a nightmare I'm frightened of anyone turning up, I don't want my partner to know and can't sleep at night..
If you read your post back yourself, you will see for yourself that the court AND the creditor have confirmed that the account is being placed on hold pending your completed N245 application.
With regards to payment (for the N245 application), a cheque is perfectly acceptable and you will need to read the guidance notes attached to the form for details of the payee.0 -
Thank you...I'm not sure if bailiffs have agreed to hold my account but done all I can, I sent completed form with cheque via recorded delivery then emailed bailiff office explaining in fully what I have done along with tracking number for form.
.Im very worried what will happen next, I'm scared tomorrow somebody will turn up as was told he was off previously until tomorrow... then I hope the bailiff will see emails from myself and PRA and hope they will see I!m trying to sort this...should have been done ages ago I know and admit to burying my head in the sand but this last year has been a real struggle with my health condition and other health problems and just could not deal with it...I am scared of someone visiting and not sleeping well and my condition been bad this last few weeks I'm just hoping I'm left alone now until an agreement sorted..Thanks for your help, will keep you posted0 -
As Stopit said in post 2, this is the court bailiff. He knows you have are putting in an N245 and so you will be at the bottom of the pile.
Court bailiffs (in my experience) need little persuasion not to have to venture out of their warm office. It's one reason (there are others) why any creditor who can use a High Court or 'private' bailiff does so. Consumer Credit Act debts do not have that option, and long may it remain that way.
My local court bailiff is a thoroughly nice chap, and even carries N245s around with him and helps people to complete them!0 -
Fatbelly...I do hope you are right, I've done what I can so fingers crossed..Thank you0

There's a lot of mythology about scary bailiffs etc, much of it from long ago, and some based on a certain TV show which shows what private companies do when authorised by the High Court not the County Court.
County Court bailiffs are frankly nothing to worry about. As Fatbelly said, some even help with the procedural stuff as they'll know that many people like you are too scared to fill in the forms etc as they think it'll make things worse.
As I said to begin with, you needed to get the N245 filled in. The one were sent is the same one as you were linked to online, maybe with an SAE for the Court, but nothing more really. Still good that you've got that sorted. Hopefully it'll be accepted and you can stop worrying about it, but even if not, it can be dealt with.
