Warrant of control please help

Options
Hi
I hope someone can help yesterday I received a warrant of control letter from PRA group re an old welcome finance loan, its something I should have dealt with but didn't due to ongoing health issues. The letter states that bailiffs will call and it was issued through my local county court I rang up PRA and spoke to a lovely lady , i explained everything and she said they will hold my account for 30 days and will contact bailiffs and suspend action, i n the meantime I need to fill in a n245 form to set up a new payment plan, I want to stick to this and so will get the form and fill it out asap but as the time has now elapsed from original warrant of control I'm still scared of somebody calling round..do you think they will or will she have been able to stop it. I am beside myself with worry. Thanks

Even if they do, it's only from the County Court so their powers are limited.

Get the N245 sorted, and if anyone does knock on the door, do not answer. They cannot force entry, and they'll just go back to the court to say they got nothing and by the time any escalation can occur, your payment plan should be in place and will stop anything else happening.

I suspect you wont hear from anyone anyway.

  • Thank you for your quick reply. Am I right in thinking I have to pay a fee for the application? I just haven't got the money to pay it. Im just so scared, I didn't sleep last night for worry. The lady I spoke to yesterday seemed adamant that no one will call round as they are holding my account for 30 days to give me time but I just can't stop worryimng

If the Warrant has already been granted, the cost of this would be added to your debt already, but that's by-the-by. If you agree a payment plan, you'd only need to pay the agreed monthly payment. Maybe for a little bit longer than you'd hope because of the fees however.

As I said, I don't expect anyone at your door. But even if you do, just ignore them. They can't do anything, especially nothing like forcing entry. Just get the payment plan agreed and sorted ASAP.

OP take a deep breath, relax, your account is on hold, no one will be calling, even if they did, all you have to say through the letterbox is that your account is on hold, awaiting arrangement of a payment plan........please confirm with your office.

They will call the office to confirm this, yes thats correct, good morning, and off they will trot.

Bailiffs are nothing to be scared of, they are just agents of the court, they have rules to follow, and there is a limit to what a county court bailiff can do.

Please dont go upsetting yourself over nothing here, simply keeping the door locked is all you have to do.

Advise here on the N245 application :

    N245 form available here :

    https://hmctsformfinder.justice.gov.uk/HMCTS/GetForm.do?court_forms_id=486

There is a £50.00 fee for an N245 application, but if your on low income, you can apply for remission of the fee using form EX160 :

  • Thank you for the advice, I've had a look at the n245 form, is there a way for me to add my information and email it to the courts? I tried but couldn't put my own info in. Also should I email the courts or bailiff office as it had the emails up on website just to let them know I've spoken to PRA and they are holding my account? I'm trying to keep calm about this but I!m just so upset I suffer from anxiety and its making me worse, I just don't want them tyo turn up. I know I should have dealt with this before but I've had an awful lot of health issues.

These must be sent in hard copy form, through the post to the court.

You can fill it in online (PDF File) download and print the form, and return it.

The claim form for remission you can do the same.

  • Thanks I cannot get this sorted now til after the bank holiday, should I contact the court or bailiffs to explain that my account is being held for 30 days and I wish to set up new arrangement and will be sending a n245 form? Do you think this will stop anyone from calling?

Listen, you dont need to contact anyone now.

A 30 day hold is in place, nothing will now happen for at least that amount of time, stop panicking, enjoy the bank holiday.

  • Thank you
  • Just an update on this and a couple of questions..I rang the bailiff office at the county court spoke to a lady who said that she would send me a n245 form and she also said no one would call this week as the guy wasn't in and she will put note on my account that I'd been in touch and she was sending me a form..next I contacted PRA who said that they have emailed the bailiffs at the county court asking them to suspend any action until I get my form into them..Firstly I want to know if you think this will help my case and stop them calling in the immediate future? and also the n245 form if I can pay the fee via cheque? Sorry for all the questions, finding this a nightmare I'm frightened of anyone turning up, I don't want my partner to know and can't sleep at night..
