Self Employed Redundancy

Hello,I'm after some advice please😊
I've worked for a company self employed for 4 years,with the odd invoice mixed in,I've been told there is no work so I've been given a weeks notice!!!
The company provided me with tools to use,gave me jobs to do,I had to sign in and out every day,although that only applied to the regular staff who are there every day,if another contractor company came in to work they didn't have to sign into out!
We were told a flat hourly rate that we could charge,no overtime,payed holidays etc

Yes I feel bitter at how I've been treated and was just wonderin if there was anything I could do?

  • I personally question whether you are actually self employed, you sound like an employee of the company. I would consider the idea of getting an hour with an employment lawyer to discuss this one through.

    Yes they may but that doesn't help from the point of view of claiming redundancy pay.

    To do that the OP would have to convince an employment tribunal that they were, for employment law purposes, actually an employee. It is possible (and it has happened many times) that an employment tribunal and HMRC take different views on whether somebody is actually an employee. Neither is binding on the other.

    Been a while since i went thru something similar so things might have changed, you do have a case imo though you wouldn't be entitled to much more than a couple of weeks pay at the end of it as you have only been there for 4 years in terms of redundancy. There maybe a case for retrospective holiday pay so you should defo seek advice on that, advice comes at a price though so you need to weigh up the possible return against costs should it progress thru to a tribunal.

    The Gvt has just been defeated by a Unison action regarding tribunal fees. Old ones will be refunded and are now scrapped for new cases.

    Thanks guys much appreciated,I've more or less walked straight into another job,however I'm still going to pursue this as somebody needs to get it sorted!
    The company is the second largest in Europe and there are staff there that have been there over 30 years!!!
    Health and safety is non existent,even the accident book is locked away so it can't be used,for insurance fiddle!!!
    Many good staff have left because they won't employ anyone,I wonder why!!!!
