Hello,
I'm really hoping someone can help as I'm at a loss! I received a letter from gladstone solicitors threatening to take me to court if I didn't pay £160 parking fine. It stated that I had been written to by Minster Baywatch and given 2 chances to pay lesser amounts. I explained I've never received the letters and don't actually even recollect if I was driving that day. They asked me to email them which I did (below) and they replied (below) they say I have 7 days or they are taking me to court. I'm not sure if there is anything I can do? any advice would be appreciated. Thank you
Hello
Thank you for your correspondence.
I have attached photographs of the incident. Further details were contained in our letter of claim. Whether you recall the events or not does not impact on your liability to pay the charge.
You have given no reasonable explanation as to why you wouldn’t have received the post. However, without concession, even if the post wasn’t received, this would not impact your liability to pay. The correspondence was sent after you became liable.
As you did not pay the charge within the 28 days allowed you are in breach of contract. Breach of contract entitles the innocent party to damages as of right in addition to the parking charge incurred. As you didn’t pay the charge the matter was passed to us and the debt has, as a result of this referral risen as my client’s staff have spent time and material facilitating the recovery of this debt. This time could have been better spent on other elements of their business. My client believes the costs associated with such time spent were incurred naturally as a direct result of your breach and as such claims them as a damage. The costs are a pre-determined and nominal contribution to the actual losses. Alternatively, my client does have a right to costs pursuant to the sign (i.e. the contract).
In the event payment isn’t made in the next 7 days further legal action will be taken. Payment can be made online at https://www.gslcollections.com or by calling 03330230049.
Kind Regards
Phoebe

Hello
Further to our phone conversation I would like to dispute the letter I received from yourselves today.
The letter was about parking at reel cinema in March. I'm not disputing the parking at this moment as I cannot remember that far back (so at this point do not know either way) however I am disputing the threat of court and request for payment of £160. I do not understand why I have not received any earlier letters? Evidence? Opportunity to pay?
Please could you provide me with the evidence and opportunity to pay the initial amount (which I assume is less that £160?)
Once I've received the above I can check if I was driving the car that day, if I was near the cinema and make an informed decision regarding whether to pay or dispute the case.
Thank you
Tammy

Sounds like the first Gladstones letter was from DRP and a gladstones pimped out letterhead
That is where the extra £60 comes from.
If DRP was involved as a debt collector, they offer parking firms
a "no win no fee" so as they did not win, it was free to the PPC.
Therefore the £60 cannot be claimed by the PPC
The real Gladstones letter is very tame for them.
Your reply is delightful and puts the onus back to them
and they will have to come back with a smart answer
to show they are able to prove who was driving.
We know that cannot.
Gladstones make huge mistakes and they are known
to be completely incompetent especially to the courts

Hello
Thank you for replying 😊 Gladstone have replied to my email (the top email is their latest reply).
They've also sent me photos but you can't see who is driving.
I'm not sure how to reply to them now??10k in 2010 challenge £0.00/£10,000 - important thing is that I am going to try.

Request details of the:
1. parking contract alleged to operate between driver and PPC (the sign)
2. Contract entitling them to issue parking charge
3. Contract entitling the PPC to pursue court proceedings in place of the land owner
4. Proper details of the parking event(s) in a letter of claim that sets out appropriate details sufficient for you to investigate the merits of the claim, should it be possible to resolve matters pre-proceedings.
I should add that I expect them to provide none of the above. This is about working towards maximising your chance of costs recovery if you successfully defend this.0 -
And have you read the NEWBIES thread post #2 about small claims and pre-claim letters like this?
No asking where it is...read my signature - it is 2 clicks back...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
