Bellway Refunds

Can anyone help or advise please.

We reserved a house with Bellway on accepting an offer on our current house. We paid £3000 for flooring which was fitted the next week.
Our buyers mortgage fell through and they had to pull out of the sale. Bellway then cancelled our reservation as we could not exchange with them but refused to refund the £3000 for the flooring saying it had been cut and fitted. At the time of purchasing the flooring they never told us what would happen if they had to cancel the reservation or gave us any kind of paperwork stating any kind of addition would be refundable if they cancelled.

Do I have any rights to a refund? It isn't us that cancelled the reservation. If so how do I get the refund if they refuse
If no right to a refund do I have rights in regard to asking to be given the flooring?

    What does your signed reservation document say regarding refunds?

    The only thing on the reservation form about a refund is a partial refund of the reservation fee.

    There is nothing on any paperwork I have been given regarding refunds for anything else in the event of a cancellation.

    Have you not signed any paperwork regarding options?

    We had a specific document for options which we had to sign, with various terms and conditions for the options.

    Tell them you still wish to purchase but need to find another buyer.

    If they refuse, you could try insisting on a refund of the £3000.

    Or ask for the flooring????

    They have completed work upon your instruction and now you don't wish to pay for that work since its now not convenient. is that the basic facts of the question?
  • It is Bellway who have cancelled our reservation. I have asked for more time to find a buyer for our current property but Bellway refused. If I cancelled I wouldn't complain about losing the costs.

    I asked them for a refund of the cost of flooring which they have refused saying it has been cut and fitted. I have also asked for the flooring to be taken up and given to us as it's essentially ours they haven't come back with an answer yet

    I agree with this, but bear in mind there was a cost associated with fitting and imagine there will be costs to remove it, unless they allow you to go take it up yourselves.

    I sniffed a rat at this when we were choosing our flooring and fittings for our new build. Luckily all carpets and flooring were thrown in for us as part of the deal, but we did enquire about extra shower fittings and outside taps etc, which came back at nice prices. Knowing that my sale chain could fall through right to the end, I wasn't willing to take the risk and pay for extras.

    Nothing was ever mentioned that this would be refundable either...

    In hindsight I should have asked. They had told us for 2 months that flooring would be included. When we reserved suddenly we had to pay for it. We were told we only had a week to pay otherwise we couldn't have it despite the house being 10 weeks from completion. I went away and checked prices with local flooring dealers and Bellway turned out to be cheapest and more convenient.
