Parking charge not a parking charge? Excel parking services

Hi,

I require some help as i have been issued a windscreen ticket. Ticket issued by Excel parking services ltd ticket man gave ticket via myparkingcharge.co.uk. the keeper was not the driver at the time, i have parked there previously and buy a ticket at £2.50 for 15 hours but by mistake only put in £2.40 witch left me for on 2 hours and the cost for 1 -2 hrs is only £1so i even paid over. so i was issued the ticket but the ticket was a re that reads ;

"! ATTENTION! DOCUMENT ENCLOSED THIS IS NOT A PARKING CHARGE NOTICE WARNING ONLY THE PERSON IN CHARGE OF THIS VEHICLE IS AUTHORISED TO REMOVE THIS DOCUMENT . " can anyone explain if they have had this car as it is diffrant and never reads THIS IS NOT A PARKING CHARGE NOTICE. so what is this if it is not a parking charge im baffled?

Also i would like to point out that on the website the photos was taken 3 mins after the time ran out on the displayed ticket but was inputted on the system 18 min after. can they do that?

wait for the NTK and then use the black text template , appealing as KEEPER

this will be refused , they wont be cancelling , so after that its IGNORE unless you get an LBC or an MCOL in the post , for 6 years

DO NOT reveal who was driving , so edit post #1 accordingly

if you are looking for a magic bullet , there isnt one , unless you get a landholder cancellation

Search this board for myparkingcharge.co.uk and you will find loads of threads. This style of 'fake PCN' started a few months ago and complaints have been made to the DVLA, who appear to have swallowed the line that 'the IPC have told us this is not a parking charge/notice to keeper' and so the DVLA believe it!

The point is, this 'PCN' certainly misleads and impersonates a PCN (and offers ALL the functions of a PCN, by offering 'appeal' and taking PAYMENT online, if people are that stupid). So despite the DVLA having the wool pulled over their eyes, clearly is IS fulfilling the function of a Notice to Driver, by any reasonable interpretation!

Then Excel or VCS get the keeper's data earlier than they would have been able to, and send out a NTK within a fortnight. None of this is POFA compliant (see the NEWBIES thread) but no-one seems to care.

I would be complaining to your MP and in writing to your local Trading Standards (not the CAB). Complain that this is a misleading business practice, does not fulfil the requirements of para 8 or 9 of the POFA (it is neither one thing nor the other) and yet the company is then alleging that they can hold registered keepers liable.

Your appeal will get nowhere fast; I hope you've realised that from the NEWBIES thread, so your expectations are not high. No appeal is worth trying to any IPC firm, which is another thing to rant about to your MP and TS (NOT the CAB = useless).
