    YES

    If you sign the new agreement, you can be pretty sure it will be legally binding, whereas it is unlikely that the existing one is any use. Why do you think they want to put so much presure on you now?

    Honestly I think Littlewoods and their ilk are best avoided. Catalogue prices seem much higher than on the High Street and their interest rates are usurious. It's tempting with Christmas coming along.....but avoid.
    I used to think that good grammar is important, but now I know that good wine is importanter.
  • UNDER NO CIRCUMSTANCES SHOULD YOU SIGN A NEW AGREEMENT

    Firstly you need to establish if the debt is legally enforcable, send a CCA request to them. I would not halt any payments at this stage, only pay what you can afford, regardless of whether Littlewoods accept it or not they cannot stop you paying that amount nor can they disallow it.

    when you get a response from them regards the CCA request post it up here and we'll advise you what to do next. Littlewoods are notorious for not keeping accurate copies of agreements, in fact ther policy is to pass the original documents onto a third party who keep varied records. the fact they want you to sign a new agreements leads me to believe they hold no regulated executed agreement for you.

    Interestingly enough i got a CCA agreement thru in the psot for a Littlewoods catalogue i started this month. They are obviously tightening up on these things due to requests like this!

    (Incidentally, before anyone shouts at me, i had £15 to spend voucher so i spent £15 on a cardi and put the book in the recylcing bin! No more shopping for me. Have checked and the cardi is on my bill, and my balance is zero.

    Will resist urge to not spend more, book is in the bin, but online shopping can still call me. Will close the account soon. i promise!)
    I'm just a seething mass of contradictions....

    What Littlewoods have started doing is either reconstructing documents or ammending newly drawn up agreements with info they already hold on their computer systems. I'd be interested to see what they have provided for you, most likely it does not comply with the Form and Content requirements laid down in the ACT & Regulations, are you able to scan a copy or use a digital camera and post it on the forums? (remember to block out any personal details). I have not yet seen a littlwoods or Kays or Choice agreement yet that i would deem legally enforcable and i've seen quite a few!!

  • Had a reply from Littlewoods finnce today.
    "With reference to your letter received requesting a copy of a credit agreement.
    Under Sections 77 and 78 of the CCA 1974 we are required to provide a copy of the executed agreement (if any).On th assumption that you have signed the agreement supplied to you at the time of opening your account.We enclose a copy of your signed agreement,with the requirements of the Consumer Credit (Cancellation Notices and Copies of Documents)Regulations 1983.
    We look forward to receiving your proposal for payment."
    The attached document which is singned and dated by myself (though can't remember signing it,was back in sept 05)says above the signature "This is a credit agreement regulated by the consumer credit act 1974."
    So i guess i'm stuck with it!!Didn't think they had a credit agreement as about a week ago they wrote to me asking:
    1.Do you want to continue ordering on your account?
    2.Do you want to obtain credit from other lenders?
    3.Do you want to prevent further charges?
    If yes phone XXXXXXXXXXX
    If no phone XXXXXXXXXXX
    Any suggestions on a follow up letter to them?I've asked for reduced payment per month (£100)max i can afford but they want £500 or sign a new loan or over to debt recovery,then after i CCA them they send me the letter with multiple options,then they send me this copy of a cca asking for a proposal of payment.???:confused::confused::confused:

    Hi,

    i would be very surprised if what they have sent you equates to a valid agreement and is enforcable. Most likely it is lacking prescribed terms and does not conform to the statuatory regulations. Are you able to scan a copy of it for us to see, if so please blott out any personal details first

    Also,the 14 days were up tomorrow,and i receive this today...
    Really can't remember signing this form either,although it is my signature on the photocopied document.
    What has to be on the document to make it enforceable?
