Parking Charge Notice - Help on technicality please

Hi,

Please accept my apologies if you have seen this before but I have tried searching and cannot quite find the exact info I am after.

I received a Parking Charge Notice and the Notice to Keeper was provided in the form of a letter showing my entry and exit time via a photo from number plate recognition - the site is a retail complex and is unmanned so tickets are not issued on the vehicle.

As declared in the PCN / NTK the contravention occurred on: 30/06/17, and the issue date (posted): 09/08/17.

I first thought it was a long time past the event to send me a PCN so decided to check what the legal time frame required for issuing PCN/NTK and cannot find anything that categorically states the legal requirement, although from all the advice I have found it seems the amount of time that notification needs to have taken place seems to range between 14 days or 28 days - if either of these are correct I can claim they have not observed this as it's over both of those times.

I am hoping someone can tell me the actual timeframe and if I have a case on this technicality, and point me in the direction of the law/act/guideline so that I may quote it when responding.

    This is all covered in the Newbies Sticky - Which you need to read carefully before doing anything else. Especially before contacting a PPC - You need to word things carefully to avoid identifying yourself as the driver.

    Here you go. The Protection of Freedom Act 2012. This specifies the timescales for a Notice to Keeper to be valid.

    There is only a stat. time limit for issuing a NtK IF they want to hold the keeper liable under POFA
    Para 8 sets out 29-56 days
    Para 9 sets out 14 days

    The information you are asking about is given in post 1 of the NEWBIES in the section after the BPA blue template, and before the section about the second stage appeal.

    Remember that the date of the alleged event is day zero.
