    As has been pointed out the problem here is that you used an intermediary. The carrier will invoice Parcel Hero for the additional cost sometime after processing the package, Parcel Hero then need to process that and bill you. That takes time. You have to remember that the contract between Parcel Hero and TNT is a business to business contract, things work differently and there is no requirement for terms to be reasonable or fair unlike in consumer contracts. TNT will bill PH periodically for shipments on their account, not on a per-package basis, so a delay of two months before the extra charge works its way through to you is entirely possible.

    You complained about not being informed about the extra cost prior to delivery; if you read the T&Cs and knew that could happen why did you ask?

    Nobody here can tell you what you want to hear, if you don't have evidence of the package dimensions and weight then you don't have it. Your best bet is to refuse to pay, it will then be for a judge to decide on the balance of probabilities who is in the wrong. This may end up costing you more. Good luck.

    I knew an overweight parcel etc could incur extra charges. Since they don't say what you've explained to me in their terms and conditions, I assumed any extra charge would be notified while processing the item, not months after.
    My complaint was only referred to the delay in notifying me and I am annoyed because I am absolutely sure that packaging wasn't 5kg, not even volumetrically.
    Thie possibile delay of even weeks should be made clear.

    The limitation act sets the period of limitation for claims. For those founded on simple contract, that limitation period is 6 years. In comparison, 2 months doesn't seem that bad.

    That being said, it all comes down to whether the extra is owed or not. Ask them for the proof that the parcel was not within the measurements you stated. Perhaps ask simplybe if they can confirm the weight and other dimensions - you might not be able to prove beyond any doubt that it was the trousers you sent but civil claims work on balance of probability. So you only need to prove something more likely happened than not. If you have any texts, emails etc from your sister discussing what was sent, use that too. Especially if they predate parcelheros request for additional payment.

    I have asked them in my appeal to send me the audited measurements and the ones I gave to them as I can't see them anywhere now.

  • I wanted to add I simply forwarded the packet SImplyBe sent me and it contained 2 pairs of linen trousers, which anyone would agree can't have a weight of 5kg, not even volumetrically.

    I am sure I had to include the description of the goods when booking the service and I would have put it was trousers.

    In the email [ from ParcelHero ] it says TNT found the weight to be 5kg versus the weight of 1kg stated by me.
    Is there a screenshot, or other reference to a formal TNT document ? Is there a way to find out directly from TNT, what their side of the story is ?

    ParcelHero are charging you extra, on the basis of a reported assertion by TNT, that the package was heavier than you think. One or more of the 3 parties is mistaken or lying, and the easiest to trace would be if ParcelHero are misreporting TNT. If they are, then maybe TNT should sue them for defamation, and maybe TNT could support a class action for overcharging.

    I recently sent a parcel to Italy, Parcel Hero were the cheapest quote I got and when I printed out the label it clearly said <1kg when I had booked it as 5KG. I cancelled and reported them to TNT who told me it was an ongoing problem and all their parcels were being checked.

    No wonder they were the cheapest.


    In the OPs case it could be that TNTs weight banding is <1kg, <5kg, <10kg etc
  • Thought I'd update with the outcome.

    ParcelHero said I don't need to pay anything after my "appeal".

    Yeah, they were gonna charge me volumetrically as according to them measurements were 50x50x10. Absurd. I measured that packet accurately with a tape measure.

    I replied asking them for anything official from TNT and the picture the machine takes when the packet was on the conveyor belt.

    TNT and SimplyBe weren't able to offer any help. I even asked MyHermes, who are the couriers for SimplyBe, and they couldn't confirm dimensions either.

    I also added in my appeal email that they can't expect anyone to hold onto packaging after 2 months and that they don't state anywhere that charges about weight adjustments can apply after weeks.

    They just replied telling me TNT accepted my appeal :j :rotfl:
