Advice on voucher refund from Argos for faulty goods

please can you advise me on a consumer rights query....

I bought a fridge from Argos due to be delivered today. It was faulty (huge gash in the door), so I refused it. The earliest they can deliver another one is two weeks, Argos offered me another fridge up to £30 more but much smaller, which I also refused. I asked for a refund. I paid partly in Love2Shop vouchers and partly on a credit card. They are refusing to give me back full credit card refund or part credit card and part Love 2 Shop vouchers. They are insisting I can only have Argos vouchers. I have said this is against the law as advised on Martin's site under consumer rights act information. But they are ignoring this and saying I paid in vouchers, their system doesn't differentiate between whose vouchers they are.

I spoke to the call centre, and I have emailed through Resolver and Argos have emailed back saying the same thing.

Love2Shop vouchers can be spent in many places. Argos vouchers (£155 worth) cannot. I do not need to (and hopefully won't need to) replace any more expensive items.

I'm sure this exact question has popped up before (and it was argos & love2shop vouchers too!).

They need to refund any monies that were paid and also return anything else that was provided in payment. If it cannot be returned in their original state then you have a claim for damages.

They don't have to return the exact voucher you paid with, but it would have to be the same type of voucher. As you quite rightly note, argos vouchers are not the same as you can only use them with 1 retailer.

Tell argos that if they are unable to refund love2shop vouchers, you'll be claiming damages plus all reasonable costs incurred as per the Consumer Rights Act section 20 paragraphs (18) & (19).

Does your receipt show that you paid with Love2Shop vouchers? If not can you otherwise evidence you used them?

Thank you for your reply, sorry for not finding that post. I will write again - they have sent the complaints address as they refuse to do anything besides Argos vouchers. I will include the specific sections you said - thank you so much that's really helpful. :j
