Ongoing car insurance claim (fraudulent third party)

Morning all, just looking for a bit of advice from those with more experience than me. In early July a taxi driver hit the rear of my car, resulting in a total loss. Following the incident the other driver said he would have to claim it was my fault, despite me doing nothing out of the accord. Along with his dispute of liability, he has now said I reversed back from the T-junction where the incident occurred (total lies) and claimed that there were more.passengers in the car than therelying was for personal injury. I'm concerned that the false witnesses might send my claim into jeapordy. Help!:(

    In terms of the liability dispute, the driver will need to prove you reversed in to him, similarly you would need to prove he hit the rear of your car. Do you have any evidence? CCTV / Dash cam?

    In regards to the witness and passengers - your insurers will need to be able to prove that the witness is lying / there were less passengers than they are claiming.

    Did you take photos at the scene of the incident? Can you see the people in the background?

    The reason every one needs proof is that your insurer cannot just decide you are not at fault, and they cannot just decide not to pay out for a injured persons claim. If they maintain their position on the 2 points above, the passengers / drivers solicitors will issue court proceedings, and it will go to court - this is where evidence will be needed to 'back up' what each person is saying.
  • I don't have proof in terms of liability although the fact my car had been a write off and his minor damage should probabky work in my favour?
    In regards to the evidence backing up that there weren't 3 passengers I have a witness that can provide a statement proving so if that's sufficent?

    Did he explain why ?

    Was this an independent driver, or did he work for a firm ?

    If a taxi driver misbehaves, the licensing council gets involved. They may have records of him doing dodgy stuff before. You should certainly make a complaint to them ; maybe to the firm first.

    Your car being written off has no bearing on liability.

    If you have a witness to the accident / number of passengers then you need to provide this to your insurers, as your witness is your evidence.
