So, the driver leaves site, so what. Who is not to say that someone already shopping in the complex drove the vehicle away?
Unless the Parking Weasel saw the first driver return and drive away they have no case. You never know how far you can go until you go too far.0 -
Agree. 'left site' cases have to be the most ridiculous term/condition dreamed up yet, by desperate PPCs.So, the driver leaves site, so what. Who is not to say that someone already shopping in the complex drove the vehicle away?

Even if the driver admitted leaving site it would fail as an 'unfair term' under the CRA 2015
I strongly advise anyone being taken to court with such a case to issue a DPA counter claim and push for unreasonable behaviour costs under 27.14(2)(g)0 -

Almost as ridiculous as Parking Eye's "parent and toddler" spaces. What's the legal definition of a "toddler"? What's the age limit?. Or is there a height limit?
Especially stupid because most PE sites don't have bods on the ground and I doubt if their ANPR cameras can spot things like that. What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -

Funny you mention that, I work at a local supermarket that is "managed" by Highview, they have never ticketed anyone for parking in P & T spaces, or disabled bays, there is no-one physically there at all. I never noticed until I started working on my own case. Their signage is awful too!

Seems he's left this site too!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
