Ignored the nature of appeal.

An appeal was made online to Parking eye because the alleged incident was 17th June and the letter was dated 22nd July. I cited the Protection of Freedoms 2012 regarding the timelines they should abide by whilst not admitting being the driver. The appeal has been refused with the reason "no valid ticket was purchased" Well we never suggested we did. It is a motorway service station with a time limit. How can they refuse the appeal based on something we did not suggest we did? What can I do?

    They do that sometimes, there is not a great deal of acuity amongst PPCs.


    However, it can be to your advantage if they take it to court and you win. It adds to their unreasonable behaviour and strengthens any claim for CPR27.14(2)(g) costs.
    You never know how far you can go until you go too far.

    Haha, course they refused it, isn't it obvious why? This is a case of their mind games. They have managed to bamboozle you with a template rejection letter you should have been expecting.

    Clearly, what you now do is: win at POPLA, as was the plan all along.

    They have now succeeded in confusing you, into losing sight of the fact you will win at POPLA. That's why they rejected it, because they know not everyone will then pursue the same (winning) argument at POPLA and they are trying to call your bluff.

    Call their bluff, instead.

    This is a slam-dunk WIN at POPLA for a keeper, and they will not contest it, they just hope you don't know that. This is so easy, like taking candy from a baby. You'd have to try very hard to lose!

    Easy enough for you to copy a recent Parking Eye POPLA appeal (2017 only) where a person has one of their 'golden tickets' (like you do, a non-POFA one). Search the forum for 'POPLA ParkingEye golden ticket' and copy/adapt/edit a long POPLA appeal that someone has already used and win with.

    But show us first.
