Evans Haleshaw refund - at my wits end

I used the move me closer service paid the £200 and was told the car would be with me within 10 working days.

It gets to 8 working days and i had heard nothing. Rang the dealership and was told someone would ring me back. No-one did.

Rang again on the 9th working day, spoke to someone and was told the car would be with me by tomorrow (10th working day).

So I rang the next day and low and behold the car wasn't being moved. At this point, I decided to go into the dealership myself as I was so fed up of being fobbed off on the phone.

Went into the dealership, was told there was no-one to deal with me. I said I'll wait until a manager is free. Finally waited and seen the manager.

He told me the car would be here by Monday. I said that's not good enough, your terms and conditions say 10 working days and I've been told for days now the car will be here by now but it isn't! So I don't believe you!

Cut a long story short, it was agreed I was entitled to a refund as they had broken their terms and conditions not getting the car moved within the 10 days. I filled out the refund form and was told the money would be in my account within 5 working days.

Guess what..

It's been 5 working days yesterday! I rang them Thursday and was fobbed off yet again. Telling me they were too busy to deal with me!!! I am completley fed up by this point. So I ring their head office who say they can't deal with my claim because it has to be done through the dealership.

So I rang again yesterday and the dealership kept telling me the money would be in my account. It wasn't.

Today, I spoke to the manager again who told me he doesn't know why I don't have my money. I said well what's going to happen? He said he'll ring me Monday. I said if you don't know why I haven't got my money since Thursday, how is it going to be any different by Monday?

I have no idea what to do now.

We have a disabled child and I'm currently pregnant, so £200 is a lot of money to us.

I have made an official complaint but the issue still hasn't been resolved. Where do I go now?

    Have you tried initiating a chargeback with your bank?

    Also, its generally a bad idea to start claiming you desperately need the money due to having a disabled child and being heavily pregnant unless you want to get flak for it.

    I know you're irked at having to chase your money, but its best not to get caught in up details that are largely irrelevant to your issue.

  • I paid on my debit card, so I've been told there's nothing I can do that end.

    Having a disabled child is relevant, I need a car because of my child's disability and until we get this money back I'm unable to find another car/pay the insurance for a new one. Like I said, £200 is a lot of money to us.

    People can give me flack all they want, it still adds to the stress that I don't need.

    You were presumably going to pay more than £200 for the car in total. So you have the rest of the money to put as a deposit on a new car/insurance while you wait for the refund.

    Ask your bank about a chargeback for goods not received, and send an email to head office/the dealership saying you would like your refund and will start court proceedings if you don't have it back in 5 working days (see letter before action advice on these forums)

    Have you spoken to the accounts department? Asked to be put through when you call the main number. If they ask a reason why just say an outstanding bill still needs to be paid.

    Once you get through explain the situation that you are due a refund which has been signed off by whoever the manager is. Ask if it has been paid. If it hasn't been paid do they have sight of it. If they haven't got any more info ask if they can help you.

    Dealerships are notoriously slow at giving refunds. We sell cars and when dealerships f*** up and misdescribe cars we have to then chase them for a few hundred pounds back. We get told all the time, yes the refund is coming blah blah blah... Often it takes a friendly conversation with the ladies (more often than not) in accounts who despair of their salesmen colleagues to get the situation resolved.

    but that did not stop you parting with it for a new car at the time.

    do you not already have a car or did you part ex that in the deal? tell them to shove the car and go elsewhere once you get your money back.

    Why would that be? Is this site swarming with sadists?

    I got a refund from an Orange shop by standing around in the store and shouting at the manager about how useless they were. Eventually they realised it was hurting trade, and paid up straight away. Go and shout in the dealership. Introduce yourself to every customer and explain your are trying to obtain a refund that has been apppoved and not paid. Tell any member of staff that approaches you that you want the refund now, not tomorrow, not Monday. Make yourself the manager's biggest problem of the day.
