Carpet discontinued after ordered but before fitting

We ordered some carpet from Tapi carpets recently

When ordering, we informed the salesman that we were ordering the first of a couple of batches as we are doing our house in stages (2 stages almost certainly). We completely understood there may be subtle or slight shade changes if the two "identical" carpets are from different batches.

My wife jokingly said "as long as you don't discontinue the carpet" to which he said that would never happen as it is a very popular range

We ordered the carpet and left the fitting to be booked once we had finished see decorating. We finished the decorating and went back in today to book a fitting date only t be told that the carpet has been discontinued

He reassured us that our batch was safely in the warehouse :-)

We want to cancel the order as the carpet is being discontinued and our second batch would not match. He said you cannot cancel the order once paid for

Where do we stand on this?

I've not escalated it yet above the store but would like to know my options.

    Well, unless the order (contract) for the carpet was for the whole house (which from what you said it isn't), or has that its cancellable if the carpet is discontinued before fitting, your only hope is that they let you cancel as a good will gesture, it'll be your word against theirs what was said regarding the likely hood of it being discontinued.

    I think "lies" is a bit strong. If the manufacturer had made the carpet for a long time and it still sold strongly, it was probably the retailer's salesman's genuinely-held belief that it was unlikely to be discontinued.

    Are the future carpets going in different rooms? If so there are thousands of carpets out there, you'll either find one close enough to not notice the difference, or choose one just that little bit different so it looks as if you did it on purpose.
    Tall, dark & handsome. Well two out of three ain't bad.
  • The carpet may only be discontinued with Tapi. They do not make the carpets and the manufacturer may still be supplying it elsewhere. A bit of a long shot I know.

    You probably don't have any recourse with the store as the carpet would have been cut to your sizes (bespoke), so unless they change their mind regarding a gesture of goodwill, there may not be a lot you can do about it.
