antisocial behaviour,taking pics of my children

ive posted in houses buying and selling before about my scum neighbours. the thread is titled
nightmare neighbors, need quick sale

my storeys on there but basicly we are private home owners and we have a housing association attactached to us.
we have already complained about the music and are currently keeping a noise log but last night it esculated.
husband went round as music came on loud at 9pm. the scum had been drinking and shouted. she said she can hear our children screaming at 7.30 am and shes taking pictures of our daughter in the garden. at that point my husband said he was phoning the police and walked off. she came round 5 minutes later saying she hasnt taken pictures and she didn't realise what time it was.

my daughter is autistic and can refuse to wear clothes, isn't toilet trained, and can be very loud. life is challenging enough.

so now im panicking and im furious she has photos of my daughter. what can i do?

    Why? What do you think she's going to do with them? Sounds like she was trying to threaten you back by saying your household isn't always quiet either. Doesn't sound like she's threatening to sell them to pervs.

  • i don't want her having photos of my daughter on her phone!! perverts didn't even enter my mind, i'm more conscerened about her sharing them and laughing
  • If she has taken photographs from a public place of things visible from there, then there is nothing you can do, there is no expectation of privacy when in public in this country. Anyone can take you or your daughter's photo when you are in public or visible from the street.

    The situation is different in private (e.g. back gardens etc), but even so you cannot require her to delete any photos, nor can the police. Only a court can order that (some police officers are not aware of this and think they can insist people delete photos from their phone / camera, but if they do so they are themselves acting unlawfully).

    The law is fairly straight forward, anyone can take pictures of pretty much anything.


    Except obviously indecent photos of children. So basically if your daughter is fully clothed, nothing you can do about it.

    Actually it depends where photos are taken from, presumably she's taking the photo from her own home and therefore can do as she wishes.

    I will step in here, theres very much chance the neighbour is "Scum" but at the same time having a autistic child doesn't absolve you of making zero noise its about the balance.

    I am autistic and get told if I want to get treated like a regular person I have to act like a regular person (though some obvious exceptions)

    I have lived next to neighbours in fact even now have noisy neighbours and even though its everyday noise its still grating loud at points, in part as they have laminate floor, and parents can get loud when guests arrive, never music though and a hour before kids go to bed I hear running stomping and toys dropping.

    I was basically told to accept it as they had kids.

    Its all about compromise, I don't work now but imagine when I came back from night shift at 6am and was woken at 7am by screaming kids, the general response would be "go to sleep at a reasonable hour" when thats impossible due to work situation.

    Or if im woken 6am every day by kids its my fault as I didn't go to bed same time as the kids thus I have to live my life around the kids, people were quick to complain or at least mention in passing if I had my hoover on past 7am at night but the same people would hoover as early as 7am and wake me

    So yeah compromise, in this situation however they do sound like scum but again be wary of your own noise.

    Yes this is all correct that you can take a photo on public (or your own land) and there is nothing you can do HOWEVER, if she has taken images of your child with nothing on - then that would come under child pornography even if she isn't sharing them and should be taken seriously by police etc.
    People don't know what they want until you show them.

    Can't help but think the OP is as much the part of the problem as the neighbours are.

    Obviously I don't know you or the neighbour but how are you dealing with them? You openly call them scum. You mention they are in a housing association property ( does that automatically make them prone to anti social behavior?). Are you sure you haven't given them cause to get uptight towards you? Did your husband politely ask them to be quiet or did he go round all pumped up and angry?
    As we speak, my autistic neighbours son is outside in the garden making a noise! However his parents are lovely. They do what they can to try and limit the noise and are very considerate and hard working people. However.......I have to be honest here. If they came round all angry and abusive towards me, I might well be tempted to try and turn it back on them. This is my guess what's happening.
