  • Sorry, "next week" was not the rescheduled hearing, but the date I have to supply documents to the claimant rep by - 25/09. The rep was supposed to send me an email address to send them to by the 18th but I haven't received one. I will send a paper copy to VCS on Monday and inform the court.

  • Ive already used litigation@vehiclecontrol.co.uk to serve them and the rep claimed it wasn't received. I will email again and post to VCS and let the court know I was not provided with a different email address.

    Rep was told to lie or was not provided with it by VCS, this is a tactic we've seen from VCS every time recently.

    Add a 'read receipt' to the email you forward, and take the posted version to the PO counter and get a free certificate of posting.   Staple that to a copy of the first letter in your bundle and take a scan and email the proof to court, along with any confirmation the email as 'read' that you get, too.

    You could get together as a group and send your findings and evidence to your District Judges (copying them all in by name so they can see who else has been sent the same request and liaise) and ask how to make a complaint to seek this Claimant to be considered for a Civil Restraint Order.

    I've briefly read about CROs this morning. I plan to pursue this. I will draft a letter and PM affected people I come across. It's not acceptable to treat already stressed litigants in person this way. It seems to me just another bullying tactic to try and intimidate people in to discontinuing.

    It also puts you all in danger of costs, because if the Judge believes it's the D's fault and adjourns, he/she could order the rep's three figure attendance costs against you.  This is wholly wrong and another brick in the scam. 

    You should also tell your MPs about this latest tactic by this firm, and ask them to pass on your complaint to to the MHCLG, who are currently working on the new Code of Practice we are all commenting on.

  • I lost. The judge wasn't happy that I didn't confirm myself as the driver before the hearing and that the references to "the driver" in my witness statement suggested I wasn't the driver. I thought this would get unreasonable behaviour costs against me but the judge mentioned my extensive WS and evidence was reasonable. I did however get the extra £60 allowed against me. The judge seemed to think that the appeal that overturned the striking out of the abuse of process case meant that the extra £60 was allowable. I mentioned that the Supreme Court stated that recovery costs are included in the Pcn but he never addressed this or my core defence. With interest I expect the final amount be be £220. Anyway I feel a bit sick right now but I'll be happy I put up the best fight I could. Thanks to all regulars who post here and especially Coupon Mad.
