Hi peoples.
I have read the 'newbie' post relating to appealing parking charges however i'd like a little more advice before using the 'blue text'.
For the last 3 days i have received parking charge notices from an NCP carpark in town which i regularly use on a weekend evening as its always been council owned and free after 6pm and all day Sunday. The first 'offence' was committed on the night of Friday 21st July, the 2nd 'offence' on the night of Friday 28th and the 3rd 'offence' on the night of the 30th. The first notice was only sent out on the 31st and received on the 2nd Aug, the 2nd notice was received on the 3rd and the 3rd notice received on the 4th.
I could argue that if they had sent the first notice earlier, i wouldnt have repeated the offence twice more the following weekend, but your advice in the newbie post recommends not admitting to being the driver. There is a sign at the side of the car park that you drive past to get to the gate, and multiple ways out of the carpark so you wouldnt necessarily see the sign on your way out, but in my opinion there should be a sign at the gate warning drivers that the carpark has been taken over by a new firm and there is now a charge for parking on an evening.
I have no intention of paying the fines because had i known the carpark was being run by a new crowd and there was a charge for parking on a night time, i would have either bought a ticket or parked elsewhere.
I'm looking for help/advice with additional wording that i can add to your template. Any help/advice would be great.
Thanks in advance

It is not a fine.
Simply send the BPA template in blue from the NEWBIES thread. One template per PCN. Send by whatever method it tells you to use on the PCNs.
Copy and paste and send. That's the initial appeal dealt with.
Next, go back and take pics of the entrance and signage throughout the car park, especially if the route the driver took could be such that signs wouldn't be seen, are sporadic, damaged, behind bushes, tiny print, and high up on poles. Take pictures without flash at roughly the same time as the alleged events. They are not offences.
You will need all of this for your PoPLA appeals if/when the initial appeals are rejected.
You also need to find out when NCP took over the car park, and who owns it.I married my cousin. I had to...I don't have a sister.

Hi fruitcake
Thanks for responding so quickly, everything i can find online (on my local council website) indicates that the car park is privately owned by NCP
I can't find anything that indicates when they took ownership of it but it could go back as far as March/April, which puzzles me since these are the first PCNs i've received this year and I use that car park all the time.0 -
You probably want to delete that.these .............time.
Many car parks have signs at the pedestrian exits, saying "Have you paid for parking ?" If they are absent, that would be supporting evidence.
Is there a Google Streetview or similar photo of the old sign, showing the free times ; and hence the likelihood that a regular user would not be looking out for a change ? I would argue there should be a "Note change of conditions".0 -
NCP own a lot of the car parks that they manage, so you might have to tweak your appeal accordingly. If you were not the driver write to the parking firm and tell them who was so they CANNOT hold you liable. The person who was driving the car is responsible so let them deal with it. Not you! Don’t let people with an agenda tell you otherwise.0

This car park has a small sign on the gate saying it is a pay and display carpark, but it always has been, same with all of our council car parks. But all of our council carparks are free after 6pm monday to saturday and all day sunday and bank holidays.
With regard to the exits, its an outside ground level car park with a knee high wooden fence around it which u just step over to get out, the only official entrance/exit is where u drive through the barrier.
I'm still trying to find out how long NCP have had it or when it changed to overnight charging.0
