On the information given they will not prosecute. There is no intention to defraud and the amount would be below the threshold.
Do your parents have learning difficulties, or is there another reason they cannot manage their finances and work?
You have a lot of responsibility on your shoulders, if your parents do have specific difficulties they may qualify for some support from social services. You would also be entitled to a carers assessment to see if anything can be done to help you.0 -
Thanks you so much that's calmed me down. My father has cataracts and english is not so great. My mother has big difficulty in reading english but mainly has difficulty of grasping what it means so i'm usually handling everything. Normally we get a letter from DWP two copies, I read it then I just set it aside. There was no intent to defraud.0

Is the person making the ESA claim your mother or your father? Prosecution is very unlikely on the information you have provided.0

It's my mother, she has had an accident over 10 years ago which has slowly made her feel pain when standing for so long so her advisor told her to apply for ESA. We got a letter from GP and then ESA confirmed it. My mother has not worked in the last 10 years.0

What is the threshold for prosecution as I am going to bank statements to check if my dad ever worked while on JSA. We need to prepare as best as possible to correct our mistake.0

I have received this letter, Its not nice, But on the other hand its reassuring to know that it makes people think about their benefit.
From what is posted, its most likely the DWP has received information to the fact that someone claiming state benefit that otherwise shouldn't have. And its seems in this case that's claiming whilst working.
The issues here is you do not know how much information the DWP/JCP has or what evidence they have, They have to give you this evidence and the reasons as to why they have brought you in and what has been said about your parents. You will be allowed into the interview room as a "witness" to the proceedings, how much involvement in the process you'll be allowed is another matter entirely as legally your nothing to do with your parents claim.
My honest advice would be to be honest and as open as possible with the interviewer.0 -
