Backdating Council Tax Exemption Severely Mentally Impaired Effect on other benefits

    So it sounds highly unlikely that the council will dispute the fact that the GP has signed the form.

  • On the form, there is a section where you need to put the date the person concerned was first diagnosed with the condition. My late husband had been diagnosed with Alzheimer's more than 6 years previously to the date on which we claimed.


    Although it depends on each LA, my one back dated from the date of his diagnosis.


    I never knew anything about this deduction until I read about on here about 5 years ago, and none of my friends who are carers for people with a SMI knew about it either, until I told them.

    Citizens Advice said that any refunds of council tax liability are disregarded for 12 months from the date you receive the back payment before it will be classed as capital. So 12 months to spend it before it would effect ESA or housing benefit.
