    I got a response from the landowner. A mutual friend who knows him has been communicating with him rather than myself. His response is below


    "There are 2 tkts on the system dated:
    25th Nov - 257 Days overdue
    11th Oct - 282 Days overdue.

    These have both been pursued through enforcement agencies by the contractor.

    They have locked it at our end in the system which means im unable to cancel it.

    I will spk to the Director of CPM on Monday to get a full update on the situation and see if something can be done.

    To be honest, if he had flagged it up sooner, we could ahve done something.

    When the tkt gets challenged the contractor incurs more costs and therefore reluctant to show discretion.

    I'll update you on Monday"

    My question is, at this stage can the landowner still get it cancelled and prevent them from pursuing or have we passed that point?

    The landowner can say they dont want the ticket pursued and instruct the PPC to cancel it.
    The agent should act on the landowners instruction
    They are there, after all, only on the landowners invitation.

    While the agent can ignore an instruction, it doesnt look good.

    a witness statement , signed and dated , stating that they did not want the matter pursued through the court system and they have asked the company to cancel the ticket(s) and been refused , so they ask the judge to strike out the court claim blah blah

    They won't agree to give a witness statement as they don't want to go against the companies wishes as they're working together. What's shall I do?

    Hi everyone

    I was defending a claim from UK car park management. I received the county court claim paperwork and responded to it and submitted a defence. I also stated I didn’t mind mediation. After I had done that and the court stated it will get back to me about a date for the hearing I heard nothing else. Until last week when I got a court judgment stating the judgment was passed against me and stated I did not attend the hearing! It had apparently taken place 9th January. I had no idea of it as I didn’t receive any notice about it.

    I am about to get it set aside. I have an issue about what to put in the witness statement.

    Any pointers please? Will I be successful in getting it set aside? Thanks

    The payment is due on 7th feb. After that it gets on his credit file even if I paid it off after that. What’s the probability of this getting set aside? Because it there’s a chance it won’t I’d rather pay off the debt so he doesn’t get a ccj.
