If the legal advice was keep trying to sort it out i wouldn't hold much hope on going the legal route. If you had a good case i would have expected them to take it on for you.Censorship Reigns Supreme in Troll City...0

As I understand it, the revised software makes the car drive less well ; so that it meets legislation while driving normally, not just while doing an emissions test.
I'm not surprised you've noticed a difference ; the cheat software was only necessary, because low-emission operation isn't as good.
They may not want to talk to you on the phone, but Civil Procedure Rules require the parties to try and avoid litigation, so they should answer your written questions. I'd anticipate you'll be wanting to know something like :
1) What specific differences should I expect ?
2) Are you working on better software ?
a) If so, when will it be ready ?
b) If not, what financial offset are you offering ?
If they write back saying they won't communicate at all, that is a piece of evidence.0 -
What is the actual problem you are facing?
In general - if you think you have a valid claim - the best way to proceed is to simply go ahead and issue legal proceedings through the moneyclaimonline system. It is quick and easy to do. And usually quicker and cheaper than getting repeatedly fobbed off by a big company. And it gets results.0
